EI Dorado Street • Stockton, CA 95202-1997 <br /> 937-8444 <br /> May 13, 2004 00mm4/&j, <br /> & 10p4 <br /> vvlokrl* 41V l <br /> San Joaquin County Community Development Department <br /> c/o Kerry Sullivan, San Joaquin County Community Development Director <br /> 1810 East Hazelton Street <br /> Stockton, CA 95205 <br /> COMMENTS ON THE COUNTY REFERRAL FOR A PROPOSED MINOR SUBDIVISION OF <br /> PROPERTY LOCATED AT THE NORTHEAST CORNER OF JOAN AND CARAN AVENUES <br /> (PA0400179) (APN NOS. 77-490-04 & 05) <br /> This letter is written in response to the County referral for the proposed subdivision of an <br /> approximately one-acre site at the above site into four parcels and a designated remainder. <br /> The subject site, located in an unincorporated portion of the City near Hammer Lane and <br /> Pershing Avenue, is immediately adjacent to property that is within the jurisdiction of the City. <br /> As staff from this office has already advised the project planner, Senior Planner Jennifer Jolley, <br /> the site must utilize City services in order to develop with the proposed single-family residential <br /> uses and, as such, should be annexed to the City prior to the subdivision of the site. In addition, <br /> all development entitlements and permits should be approved in the City prior to the property <br /> being subdivided and developed. It is the City's policy to not grant either sewer or water service <br /> unless the applicant has either signed a Conditional Sewer Service Agreement, agreeing to <br /> annex at a time determined by the City, or annexed to the City. In cases where properties are <br /> contiguous to the City's boundary, as in this case, annexation is required prior to receiving <br /> services. <br /> It is the City's understanding that the County has long supported the idea that urban <br /> development should occur in Urban Communities and, particularly, in cities. This is an urban <br /> subdivision that requires City services and, logically, should be developed in the City. As stated <br /> in the County's General Plan: <br /> Urban communities, including incorporated cities and unincorporated communities, shall <br /> accommodate the vast majority of the development, because it is in these areas that urban <br /> services exist or are expected. In particular, growth shall be directed to the cities as much as <br /> possible. <br /> Although the City is empathetic with the applicant's position and is willing to work with the <br /> applicant, utilizing to the greatest extent possible any documents and other work that has <br /> already been prepared for this project, it is the City's position that this property should first be <br /> annexed to the City and only after annexation should it be subdivided and developed.
