CONDITIONS OF APPROVAL <br /> PA-0400294 <br /> Ledbetter <br /> Minor Subdivision Application No. PA-0400294 was approved by the San Joaquin County <br /> Community Development Department on November 29, 2004. The effective date of approval is <br /> December 9, 2004. This tentative map approval will expire on December 9, 2007, which is three <br /> years from the effective date of approval, unless (1) all Conditions of Approval have been complied <br /> with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Raymond Hoo, 468-3164) <br /> a. TENTATIVE MAP: The parcel map shall substantially conform with the approved tentative map <br /> dated November 5, 2004. <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcels 1 and 2 shall have a minimum lot width of 65 feet, measured at the front yard setback <br /> line. (Development Title Section 9-310.8) <br /> (2) Parcel 3 shall have a minimum lot width of 60 feet, measured at the front yard setback line. <br /> (Development Title Section 9-310.4) <br /> (3) All parcels shall have a minimum lot area of 8,000 square feet. (General Plan Vol. II, pg. VI-15) <br /> c. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-900(b), the following note shall <br /> be placed on the parcel map: <br /> All persons purchasing lots within the boundaries of this approved map should be prepared <br /> to accept the inconveniences or discomforts associated with agricultural operations or <br /> activities, such as noise, odors, insects, dust or fumes. San Joaquin County has determined <br /> that such inconveniencies or discomforts shall not be considered to be a nuisance. <br /> d. TREE PRESERVATION: The Heritage Oak Trees and Native Oak Trees on the property shall not <br /> be removed. (Development Title Section 9-1505.3[a]) Development on this property shall comply <br /> with the following (Development Title Section 9-1505.5 and 9-1505.6): <br /> (1) Grade changes near or within the dripline of said trees shall comply with the following <br /> restrictions: <br /> A. No grade changes shall occur within six(6)feet of the trunk of the trees. <br /> B. No grade changes shall occur that entail removing or adding more than six (6) inches of soil <br /> in the protected zone of the trees. <br /> C. Extensive cuts or fills that are necessary beyond the protected zone shall have adequate <br /> drainage to mitigate adverse effects caused by changes in grade elevation. <br /> Conditions of Approval - 1 - PA-0400294 <br />
