Analysis <br /> Background <br /> On June 17, 1993, the Planning Commission recommended to the Board of Supervisors that Zone <br /> Reclassification No. ZR-92-16 be approved subject to five conditions. Condition No. 4 stated: <br /> Any industrial development of the parcels will require dedication of Hansen Road from the <br /> northerly right-of-way line of the Southern Pacific Railroad to and across the frontage of the <br /> project site, and improvements must be made to San Joaquin County standards for a 60-foot-wide <br /> right-of-way local industrial road from the beginning of the new construction to the site, including <br /> the bridge across the California Aqueduct. <br /> On July 27, 1993, the Board of Supervisors approved the Zone Reclassification and modified condition <br /> No. 4 to read as follows: <br /> Any industrial development of the parcels will require improvement of Hansen Road across the <br /> frontage of the project site to San Joaquin County standards for a 60-foot-wide right-of-way Local <br /> Industrial Road. <br /> On February 2, 1994, the Community Development Department approved Site Approval Applications No. <br /> SA-93-49 and SA-93-50. On March 2, 1993, at the request of the applicants, Public Works Condition No. <br /> 11 was revised for both applications. Notification of the revision, with a 10-day appeal period, was sent <br /> to surrounding property owners. On March 14, 1994, Frederick A. Robertson, James A. Stokley, Peter <br /> M. Yroz, and Duane Eckert appealed the revision. <br /> Appeal Statement No. 1 <br /> The appellant states that abandonment of the roadway in front of the subject properties will restrict access <br /> to prcpenies south of this site. <br /> Response to Appeal Statement No. 1 <br /> In response to the appeal, the Department of Public Works states: <br /> Abandonment of Hansen Road will only eliminate the County's interest in the road right-of-way <br /> for public use. Any access through that portion should remain in effect after its abandonment <br /> either by prescriptive right or by granting of an access easement by the recipient of the strip. <br /> Aooeal Statement No. 2 <br /> The appellant states that if the roadway is abandoned, there will be little recourse for downstreet property <br /> owners if the right-of-way is blocked by trucks. <br /> San Joaquin County SA-93-49, SA-93-50/Karle, Kleckner <br /> Community Development Page 7 <br />
