CONDITIONS OF APPROVAL <br /> MS-95-20 <br /> Breitenbucher <br /> On May 12, 1995,the San Joaquin County Community Development Department approved MS-95-20 <br /> subject to the Conditions of Approval listed below. This approval will expire 36 months from the date <br /> of approval unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has <br /> been submitted to the County Surveyor for approval. <br /> Those Conditions followed by a Section Number have been identified as ordinance requirements <br /> pertinent to this application. Ordinance requirements cannot be modified, and other ordinance <br /> requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Steve St. Sure, 468-3228) <br /> a. This approval is for a Minor Subdivision to create a homesite parcel for financing only, two <br /> agricultural lots, and a remainder, as shown on the Tentative Map submitted March 15, <br /> 1995. <br /> b. All existing buildings shall be set back a minimum of 10 feet from any new side property <br /> lines. <br /> C. Parcels 3 and 4 shall have a minimum width of 330 feet. (Development Title Section 9- <br /> 610.4) <br /> d. Parcel 1 shall be between two net acres and five gross acres in size. (Development Title <br /> Section 9-610.3(a)) <br /> e. The homesite and remainder parcels shall have a Notice of Minor Subdivision Restriction <br /> recorded by separate instrument concurrently with the map to indicate the following <br /> restrictions: <br /> (1) Neither the homesite parcel (Parcel 1) nor Parcel 2 may be voluntarily transferred <br /> separately from the other parcel. However, if an institutional lender forecloses on <br /> either parcel, either parcel may be transferred separately in accordance with the <br /> power of sale provisions contained in the deed of trust. <br /> 2.
