Analysis <br /> Parcels Based on Lot-Size Averaging <br /> The proposed project will create nine parcels containing 39.36 acres and a Designated Remainder containing <br /> 50.06 acres. Development Title Section 9-610.3(f), allows for the creation of parcels of lands containing up to ten <br /> (10) percent less area than the minimum area required in Table 9-610.2 may be created from an original parcel, <br /> subject to the following conditions: <br /> 1) The overall average parcel area of the proposed subdivision is equal to or greater than the minimum <br /> parcel area required in Table 9-610.2, and <br /> 2) The proposed subdivision of property complies with Section 51230.1 and 66474.4 of the Government <br /> Code if the property to be divided is under a Williamson Act Contract. <br /> The subdivision meets these requirements with the average lot size of parcels 2, 3, 4, 5, 6, 7, 8, 9, 10, and the <br /> Designated Remainder being 40.43 acres. <br /> Parcels for Certain Specked Uses <br /> Using the 50.06 Designated Remainder, the proposed project will then create a 10 acre parcel, for a proposed <br /> wholesale nursery, and a 40.06 acre Designated Remainder. Development Title Section 9-610.3(d), allows for <br /> the creation of parcels containing less area than the minimum required in Table 9-610.2 for the purpose of <br /> providing a separate lot for an existing use or a use granted by permit in the AG zone, subject to the following <br /> conditions: <br /> 1) The existing use,or use granted by permit, is classified under one(1)or more of the following use types: <br /> (J) Nursery Sales and Services: Wholesale, <br /> • The applicant is proposing a wholesale nursery (Use Type: Nursery Sales and Services, <br /> Wholesale) which may be a conditionally permitted use subject to an approved Improvement <br /> Plan in the AG zone. The use must be established prior to the recording of the Final Map: this <br /> has been added as a Condition of Approval. <br /> 2) The parcel to be created will be reduced to the least area required to conduct the operations, <br /> • Parcel 1 will contain 10 acres, which the applicant states is the minimum acreage needed to <br /> conduct the wholesale nursery. <br /> 3) The remainder parcel shall meet the minimum lot area requirements specked in Table 9-610.2, <br /> • The Designated Remainder shall have a minimum lot area of 40.0 acres, as proposed the <br /> Designated Remainder will contain 40.06 acres. <br /> and <br /> 4) A dwelling unit may be allowed on such resulting parcels only as an accessory use. <br /> • No dwelling units are being proposed with this project. <br /> San Joaquin County PA-1200230\Quartaroli 8 Associates, Inc <br /> Community Development Page 3 <br />
