Thomas Shephard, c/o Steve Herum
Variance Application No. VR-92-2
April 27, 1992
minimum improved width of 20 feet of all-weather surfacing.
Appeal Statement:
Mr. Herum states that the granting of the Variance will not grant
a special privilege that is inconsistent with other properties in
the area under the same zoning. The area along Helen Lane has
small residential parcels which do not conform to the zoning
minimum of AL-5 and AG-40. Granting the Variance will not take
land out of agricultural use but will confirm a residential use.
Response•
The granting of the Variance would allow an additional homesite
which would conflict with the zoning and General Plan density for
this area. Many of the smaller parcels on Helen Lane were created
under the EA-3 or GA-1 zoning. Since 1980, when the area was
rezoned from EA-3 to AG-40, the only Variance application approved
was on June 2 , 1983 by the Board of Supervisors and that created a
0. 82-acre parcel and a 1.54-acre parcel. In 1987, the northeast
corner of Helen Lane and Foppiano Lane was rezoned GA-1 and a
subsequent subdivision resulted in a 1.5-acre parcel and a 3 .48-
acre parcel. However, since the adoption of the Development
Requirements in 1987 , there have been no parcels created smaller
than one (1) acre minimum.
FISCAL IMPACT:
None.
ACTION TO BE TAKEN FOLLOWING APPROVAL:
None.
Sincerely,
CHET DAVISSON
DIRECTOR
CD:LG: fa
Enc.
