application for waste discharge requirements as a condition that must be satisfied prior to issuance of any building <br /> Permits for the expansion project. <br /> Based on a recent aerial photograph of the site,there is an existing process wastewater pond and wastewater land <br /> application area, and we presume that the pond and land application would have to be expanded to accommodate the <br /> facility expansion. We have been in contact with the owners' consultant regarding the need for Waste Discharge <br /> Requirements and he has assured us that his clients will work with us to obtain whatever form of permit is required for <br /> the waste discharges to land at the site. <br /> We are currently developing a new conditional waiver of waste discharge requirements that might potentially apply to <br /> this facility. However,that waiver will not be brought to the Regional Board for adoption until October 2014, so we <br /> would prefer not to require a permit application until we know whether the waiver would be applicable. <br /> We appreciate the County departments' efforts to support the Regional Board's permitting requirements. However, we <br /> do not wish to cause unnecessary project delays. If it is acceptable to the County, we would be satisfied with issuance of <br /> a Use Permit that requires the applicants to cooperate with the Central Valley Water Board and submit an application <br /> for WDRs or a waiver when requested to do so. When we request the application, we will send a copy of the request to <br /> the San Joaquin County Environmental Health Department as is our usual practice. <br /> Let me know if you have any questions or concerns. <br /> Anne L.
