Your letter states that Mr. Phillips' site is not a part of <br /> the Local Oversight Program (LOP) ; therefore, he is not responsible for the <br /> oversight costs billed to him. In addition, your letter indicates that the <br /> Central Valley Regional Water Quality Control Board (Regional Board) has <br /> jurisdiction over this site. <br /> Contamination was identified at this site prior to the County entering the <br /> LOP. At that time, the Regional Board had jurisdiction over contaminated <br /> sites- Oversight of assessment and cleanup activities at contaminated <br /> underground tank sites was transferred to the County when they entered the <br /> LOP. Mr. Phillips was notified that his site had been included in the LOP on <br /> September 12, 1990. Mr. Phillips declined to sign a letter of acknowledge- <br /> ment. However, as discussed with Mr. Phillips and Donna Schimeck of my staff <br /> on January 10, 1992, the County does not need the approval of responsible <br /> parties in order to place a site in the LOP. The County has authority <br /> purs-cant to the Health and Safety Code and local --ordinances to prevent <br /> pollution and nuisance within their jurisdiction. <br /> The Regional Board does not have jurisdiction over this site. The Regional <br /> Board does, however, act as a technical advisor to the County. In addition, <br /> because this is a groundwater case, the Regional Board's concurrence to the <br /> County's site closure recommendation is required. Mr. Phillips is encouraged <br /> to continue with the directives issued by the County. <br /> Your letter does not mention anything about the petition currently on file for <br /> the subject invoice. Shall we continue to hold it in abeyance, according to <br /> your request? <br />
