Charlotte Uram "NV!r7ON,%,,. 14
Landel s, Ripley & Diamond
Hills Plaza
350 Steuart Street
San Francisco, CA 94105-1250
Dear Ms. Dram:
UNDERGROUND STORAGE TANK (UST) LOCAL OVERSIGHT PROGRAM, SITE NO. 1622, SAN -
JOAQUIN COUNTY
This is in response to your letter dated April 13, 1992 submitted on behalf of
Robert Phillips. Your letter states that Mr. Phillips' site is not a part of
the Local Oversight Program (LOP) ; therefore, he is not responsible for the
oversight costs billed to him. In addition, your letter indicates that the
Central Valley Regional Water Quality Control Board (Regional Board) has
jurisdiction over this site.
Contamination was identified at this site prior to the County entering the
LOP. At that time, the Regional Board had jurisdiction over contaminated
sites- Oversight of assessment and cleanup activities at contaminated
underground tank sites was transferred to the County when they entered the
LOP. Mr. Phillips was notified that his site had been included in the LOP on
September 12, 1990. Mr. Phillips declined to sign a letter of acknowledge-
ment. However, as discussed with Mr. Phillips and Donna Schimeck of my staff
on January 10, 1992, the County does not need the approval of responsible
parties in order to place a site in the LOP. The County has authority
purs-cant to the Health and Safety Code and local --ordinances to prevent
pollution and nuisance within their jurisdiction.
The Regional Board does not have jurisdiction over this site. The Regional
Board does, however, act as a technical advisor to the County. In addition,
because this is a groundwater case, the Regional Board's concurrence to the
County's site closure recommendation is required. Mr. Phillips is encouraged
to continue with the directives issued by the County.
Your letter does not mention anything about the petition currently on file for
the subject invoice. Shall we continue to hold it in abeyance, according to
your request?
