Approve Use Permit No. UP-93-3 with the Findings and Conditions of Approval given In the <br /> staff report. <br /> FINDINGS <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan <br /> and any applicable Specific Plan or Special Purpose Plan. <br /> • Staff can make this finding because the proposed golf driving range is a conditionally <br /> permitted use In the AG-40 zone, which is an Implementing zone of the A/G General <br /> Plan designation. <br /> 2. Adequate utilities,roadway improvements,sanitation,water supply,drainage,and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • Staff can make this finding because the site has access by frontage on MacArthur <br /> Drive. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • Staff can make this finding because the site plan, along with the recommended <br /> conditions of approval,will ensure that all code requirements and other standards will <br /> be met. The finished floor elevation of structures will have to be approximately 15 <br /> feet above grade due to the flood hazard. The applicant has submitted plans which <br /> show that it is feasible to construct such structures. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare <br /> or be injurious to the property or improvements of adjacent properties. <br /> • Staff can make this finding because a habitat management plan to mitigate potential <br /> Impacts to the Swainson's hawk is required and will be administered by the <br /> Department of Fish and Game. <br /> 5. The use is compatible with adjoining land uses. <br /> • Staff can make this finding because a 30-foot net will protect the trucking facility to <br /> the south. Also, the slough to the west and the agricultural property to the north will <br /> not be impacted by this project and will not Impact the project. <br />
