CONDITIONS OF APPROVAL <br /> PA-0400300 <br /> Shea <br /> Minor Subdivision Application No. PA-0400300 was approved by the San Joaquin County <br /> Community Development Department on August 11, 2004. The effective date of approval is August <br /> 21, 2004. This tentative map approval will expire on August 21, 2007, which is three years from the <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a <br /> Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Jennifer Jolley, 468-3161) <br /> a. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. The <br /> property descriptions submitted with the Certificate of Compliance application shall substantially <br /> conform with the approved tentative map dated May 27, 2004. A fee is required to process the <br /> Certificate of Compliance application. (Development Title Section 9-890.4) <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of three hundred thirty (330) feet, measured at the <br /> front yard setback line. (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of forty(40)acres. (Development Title Section 9-610.2) <br /> C. RIGHT TO FARM: A Notice of Minor Subdivision Restriction shall be recorded prior to recordation of <br /> the Certificate(s) of Compliance stating that: <br /> (1) All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniences or discomforts shall not be considered to be a nuisance. (Section 6-9004[b]) <br /> 2. DEPARTMENT OF PUBLIC WORKS (See memo dated July 19, 2004) <br /> 3. ENVIRONMENTAL HEALTH DEPARTMENT(See memo dated July 14, 2004.) <br />
