CONDITIONS OF APPROVAL PA-0400300 Shea Minor Subdivision Application No. PA-0400300 was approved by the San Joaquin County Community Development Department on August 11, 2004. The effective date of approval is August 21, 2004. This tentative map approval will expire on August 21, 2007, which is three years from the effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Jennifer Jolley, 468-3161) a. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. The property descriptions submitted with the Certificate of Compliance application shall substantially conform with the approved tentative map dated May 27, 2004. A fee is required to process the Certificate of Compliance application. (Development Title Section 9-890.4) b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: (1) All parcels shall have a minimum lot width of three hundred thirty (330) feet, measured at the front yard setback line. (Development Title Section 9-610.4) (2) All parcels shall have a minimum lot area of forty(40)acres. (Development Title Section 9-610.2) C. RIGHT TO FARM: A Notice of Minor Subdivision Restriction shall be recorded prior to recordation of the Certificate(s) of Compliance stating that: (1) All persons purchasing lots within the boundaries of this approved map should be prepared to accept the inconveniences or discomforts associated with agricultural operations or activities, such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such inconveniences or discomforts shall not be considered to be a nuisance. (Section 6-9004[b]) 2. DEPARTMENT OF PUBLIC WORKS (See memo dated July 19, 2004) 3.
