The following comments on <br /> O R A V o A V I s the reclamation plan prepared by Michael Sandecki and Karen Wiese are <br /> GOVERNOR offered to assist in your review of the project <br /> The Surface Mining and Reclamation Act of 1975 (SMARA) (Public <br /> Resources Code Section 2710 et seq.) and the State Mining and Geology <br /> Board regulations for surface mining and reclamation practice (California <br /> Code of Regulations (CCR) Title 14, Chapter 8, Article 1, Section 3500 et <br /> seq.; Article 9, Section 3700 et seq.) require that specific items be <br /> addressed or included in reclamation plans. The following items were <br /> either not included or not sufficiently addressed in the reclamation plan. <br /> We recommend that the reclamation plan be supplemented to adequately <br /> address these items. <br /> Mining Operation and Closure <br /> (Refer to SMARA Sections 2770.5, 2772(c)(1), (c)(2), (c)(3), (c)(4), (c)(5), <br /> (c)(6), (c)(9), CCR Section 3502(b)(2), (b)(5), 3709(a), (b), 3713(a),(b)) <br /> 1. SMARA Section 2772(c)(6) encourages phased reclamation . The <br /> project only identifies 2 large phases for the 79 acre site. The <br /> narrative states that agriculture will be re-established in 20-acre <br /> increments, with soil from the upcoming mining area placed on the <br /> past 20-acre increment. We encourage the immediate replacement of <br />
