State the facts showing the changes in circumstances which make the subject condition(s) no <br /> longer appropriate or necessary: <br /> Condition No. 1g— <br /> The timeline reallocation request for the mine life has become necessary due to the current depressed <br /> market conditions for construction grade aggregate materials. <br /> Condition No. La.— <br /> Clarify within the Reclamation Plan that the approved flood protection berm identified in the <br /> Conditional Use Permit and Reclamation Plan will be constructed utilizing overburden from initial <br /> stripping in the newly designated first phase. The berm construction will be completed prior to mining <br /> within the FEMA designated 100 and 500 Year floodplains. The soil from the first phase placed in the <br /> section of the berm along the western property line will be utilized in the last phase of reclamation. <br /> The berm will comprise approximately 30,000 yards of soil, approximately 0.2 (two-tenths) of a foot <br /> over the 89 acre mine site, which will not affect preceding reclamation elevations or objectives. <br /> Condition No. 2.a.{1)— <br /> Clarify the topsoil stockpile setback has an exception for stockpiles which function as a flood <br /> protection berm as identified in the approved Reclamation Plan. <br />
