CONDITIONS OF APPROVAL <br /> Y <br /> PA-1100056 <br /> Henry <br /> Minor Subdivision Application and Lot Line Adjustment No. PA-1100056 was approved by the San <br /> Joaquin County Community Development Department on June 1, 2011. The effective date of <br /> approval is June 11, 2011. This tentative map approval will expire on June 10, 2014, which is three <br /> II` ears from the effective date of approval, unless 1 all Conditions of <br /> y pp ( } Approval have been complied <br /> with and (2)a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled_ <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Kevin Swanson, 468-2193) <br /> t a. TENTATIVE MAP: The parcel map shall substantially conform with the tentative map dated April 4, <br /> 2011. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Parcel Map and recorded as a separate instrument:- <br /> (1) All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) Parcel One shall have a minimum lot area of 10 gross acres. (Development Title Section 9-610) <br /> d. RIPARIAN HABITAT: Parallel to the Mokelumne River, a natural open space area for riparian <br /> habitat and waterway protection shall be maintained to provide nesting and foraging habitat and <br /> the protection of waterway quality. The minimum width of said open space shall be one-hundred <br /> (100) feet, measured from the mean high water level of the natural bank or fifty (50) feet back <br /> from the existing riparian habitat, whichever is greater. Water-dependent uses may be permitted <br /> in this buffer. The mean high water level and the edge of the riparian habitat shall be shown on <br /> the Parcel Map. The open space buffer required above shall be shown on the Parcel Map with <br /> the following note: <br /> 14 (1) Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is <br /> designated as a natural open space for riparian habitat and waterway protection.
