CONDITIONS OF APPROVAL <br /> PA-0600132 <br /> Burns <br /> Minor Subdivision Application No. PA-0600132 was approved by the San Joaquin County <br /> Community Development Department on May 12, 2006. The effective date of approval is May 22, <br /> 2006. This tentative map approval will expire on May 21, 2009, which is three years from the <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a <br /> Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Kathy Allen, [2091953-7509) <br /> a. CERTIFICATE OF COMPLAINCE: A Certificate of Compliance is required for all parcels. The <br /> property descriptions submitted with the Certificate of Compliance application shall substantially <br /> conform with the approved tentative map dated March 6, 2006. A fee is required to process the <br /> Certificate of Compliance application. (Development Title Section 9-890.4) <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of 80 acres. (Development Title Section 9-010.2) <br /> c. ACCESS: The following access requirements apply and shall be recorded in the legal description of <br /> the Certificate of Compliance: <br /> (1) A proposed 25-foot wide private easement for access to parcels 1 through 4 along parcel 2 shall <br /> be reflected in the legal description of the Certificate of Compliance. (Development Title Section <br /> 9-1150.15) <br /> d. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be recorded as a separate instrument prior to approval of the Certificate of Compliance: <br /> (1) All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniences or discomforts shall not be considered to be a nuisance. <br /> 2. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision, which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br /> Conditions of Approval - 1 - PA-0600132 <br />
