Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Deny Site Approval Application No. SA-93-42 based on the inability to make the Findings. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable <br /> plan adopted by the County. <br /> This Finding cannot be made because the proposed percolation ponds are <br /> inconsistent with Growth Accommodation Objective 4, which seeks to protect the <br /> public, existing and planned land uses, and the environment from natural and <br /> development hazards; Growth Accommodation Policy 10, which states that <br /> development shall be compatible with adjacent uses; Growth Accommodation Policy <br /> 13, which states that development shall not jeopardize public health and safety; and <br /> Infrastructure Services Wastewater Treatment Objective 1, which seeks to ensure <br /> adequate wastewater treatment and the safe disposal of liquid waste. <br /> 2. Adequate utilities, roadway improvements,sanitation,water supply, drainage,and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> This Finding cannot be made because the percolation ponds are located in close <br /> proximity to the San Joaquin River, with the potential for levee failure to occur and <br /> exposing populations to sewage contamination. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> This Finding cannot be made because of the site's location adjacent to the San <br /> Joaquin River, with the potential for levee failure to occur. Also, given the high water <br /> table and type of soil found at this location, there is the potential for the ponds to fail <br /> under wet conditions. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, <br /> or be injurious to the property or improvements of adjacent properties. <br /> • This Finding cannot be made because issuance of the permit may adversely impact <br /> public health and safety in the event of pond failure. Also, issuance of the permit <br /> may adversely impact adjacent properties and improvements.
