REVISED CONDITIONS OF APPROVAL <br /> GEORGE & BETTY VAN WEERDHUIZEN <br /> MS-92-42 <br /> Unless otherwise specified, all Conditions of Approval shall be <br /> complied with prior to the approval of the Parcel Map. <br /> Those Conditions followed by a Section Number or other Statutory <br /> Requirement are based on Ordinance requirements. Ordinance <br /> Requirements cannot be modified. <br /> 1. DEPARTMENT OF PUBLIC WORKS <br /> a. A Parcel Map is required. (Planning Title Section 9-9112) <br /> b. The Traffic Impact Mitigation Fee will be required when <br /> the parcels are developed. The fee is due and payable at <br /> the time of the building permit application. (The fee <br /> currently is $2 , 096. 00 per single family unit in the <br /> Escalon area. The fee shall be automatically adjusted <br /> July 1 of each year by the Engineering Construction Cost <br /> Index as published by the Engineering News Record. ) <br /> (Resolution R-90-304) <br /> C. The owner shall execute an Irrevocable Offer to Dedicate <br /> a twenty-five foot (251 ) wide right-of-way along the <br /> westerly property line of Parcel 3 and the easterly <br /> property line of of Parcel 2 from Magnolia Avenue to the <br /> northerly property line of Parcels 2 & 3 . (A $200 . 00 fee <br /> currently is required for processing per Planning Title <br /> Section 9-10502 in addition to a copy of the Grant Deed <br /> and a legal description of the parcels to be offered for <br /> dedication. ) (Planning Title Section 9-9430, 9-9431) <br /> d. The frontage improvements for the right-of-way to be <br /> offered for dedication in Recommendation No. 3 above <br /> shall be constructed in conformance with the standards <br /> for a 50-foot right-of-way rural residential street. The <br /> construction of the frontage improvements will be <br /> deferred, upon execution by the owner of a Deferred <br /> Frontage and Roadway Improvement Agreement of a Secured <br /> Deferred Frontage and Roadway Improvement Agreement with <br /> a deposit equivalent to their estimated construction <br /> costs prior to approval of the Parcel Map. (A $250 . 00 <br /> fee currently is required for processing per Planning <br /> Title Section 9-10502 in addition to a copy of the Grant <br /> Deed, legal descriptions of all Parcels, and an estimate. <br /> The estimate and legal descriptions shall be prepared by <br /> a Registered Civil Engineer with a typical section <br /> drawing on a form to be supplied by the Department of <br /> Public Works and submitted to the Department of Public <br /> Works for approval . <br />
