APPLICA , ION - DEVIATION SAN JOAQUIN COUNTY COMMUNITY DEVELOPMENT DEPARTMENT EThe h�' +':following findings of fact must be made by the County before a Deviation can be granted. Indicate what facts in the case of this application ort each of the findings. 1. The granting of the Deviation will not be materially detrimental to otherproperties or land uses In the area. A grant of deviation is needed to be just under the 10 acre minimum size limitation. Due to the rural residential nature of the surrounding properties, this deviation will in no way be dprrimental to thp surrounding properties. 2. There are exceptional or extraordinary circumstances or conditions applicable to the property or to the intended uses that do not apply to other properties in the same zoning district in the vicinity. Due to the alignment of Cam bell Road and the iog near the Southeastern rornpr nf the property, a portion of what would be 70 acres was broken off. A small parcel was created to accommodate the alignment of the road, thus creating a need for the application for deviation to allow for one parcel to not quite meet the ten acre minimum. 7. The strict application of the regulation deprives the property of privileges enjoyed by other properties In the vicinity. The parcel is located on Magnolia Avenue. Many of the parcels on Magnolia Avenue do not meet the current 10 acre minimum required in that area. Therefore, we request that privileges enjoyed by those properties be granted to this request. 4. The granting of the Deviation Is consistent with the General Plan. The General Plan calls for this area to remain agriculture. The granting of this deviation will in no way deviate from the General Plan designation currently established, which s agriculture.
