The County finds that each of the substantive issues raised by these <br /> letters (transportation demand management and rail crossings)was addressed and analyzed in the 1994 <br /> MEIR and the Project Initial Study, and that the letters provide no evidence of new significant <br /> environmental effects, nor any evidence that previously examined effects will be more severe. <br /> 15. Three recommendations were submitted, by San Joaquin County Environmental <br /> Health Department, San Joaquin Valley Air Pollution Control District, and SJCOG, Inc., in response to the <br /> March 13, 2012 Application Referral. These recommendations pertain to permitting requirements. The <br /> County finds that the substantive subject matter of each of the issues raised by these letters <br /> (environmental health, air quality and incidental take of listed species)was addressed and analyzed in the <br /> 1994 MEIR and the Project Initial Study, and that the letters provide no evidence of new significant <br /> environmental effects, nor any evidence that previously examined effects will be more severe. <br /> 16. All feasible mitigation measures and alternatives identified in the 1994 MEIR and <br /> the Specific Plan 11 Initial Study have been incorporated into the Project. The County adopts those <br /> mitigation measures and alternatives as enforceable conditions of the Project. The conditions of approval <br /> for the Major Subdivision application, including the Mountain House Master Plan and Specific Plan I San <br /> Joaquin County Mitigation Monitoring Program are included in the staff report and adopted with the <br /> project. <br /> V1. FINDINGS REGARDING TENTATIVE SUBDIVISION MAP <br /> 17. The County finds that the Tentative Subdivision Map is consistent with the <br /> County General Plan, the Master Plan, Specific Plan II, the Public Financing Plan, and any other <br /> applicable plan adopted by the County. The Map is discussed in the Project Initial Study and also in staff <br /> reports presented to the County. The County adopts the conclusions, analysis and explanations <br /> contained in the staff reports and the Project Initial Study. The County approves the Map for the Project, <br /> subject to the Conditions of Approval. <br /> 18. The Map contains all information required by State Law. The Map provides, to <br /> the extent feasible given the nature of the site and the challenges faced in designing a viable <br /> development project, for future passive or natural heating or cooling opportunities. <br /> 19. All applicable provisions of the Mountain House Master Plan Development <br /> Agreement have been met. <br /> 3 <br />
