ZR-91-9, DEVIATION <br /> APPLICATION NO. DV-91-2 AND MINOR SUBDIVISION APPLICATION <br /> NUMBER MS-91-69 OF E.J. VASTI AND R.C. HERNANDEZ (C/O <br /> R.C. HERNANDEZ) <br /> ---------------------------------------------------------------- <br /> The Development Services Division has reviewed the above-referenced <br /> application and will recommend that the Planning Commission <br /> recommend approval of ZR-91-9 to the Board of Supervisors. The <br /> Development Services Division is expanding the area to be <br /> considered for rezoning to Rl-U. The expansion includes the entire <br /> area bounded by Horner Avenue to the north, Del Mar Avenue to the <br /> east, Main Street to the south and Carroll Avenue to the west. <br /> The Development Services Division will be denying the Deviation <br /> Application because staff does not believe that Findings "b" . and <br /> "c" . listed under Section 9-2104 can be made. Finding "b" states <br /> "There are exceptional or extraordinary circumstances or conditions <br /> applicable to the property or to the intended uses that do not <br /> apply to other properties in the same zoning district in the <br /> vicinity; " . There are no exceptional or extraordinary circumstance <br /> or conditions on this property. Finding "c" states "The strict <br /> application of the regulation deprives the property of privileges <br /> enjoyed by other properties in the vicinity; " . This property is <br /> not deprived of privileges that are enjoyed by other properties in <br /> the vicinity. The other properties have had and will have to meet <br /> this requirement. <br /> The applicant has indicated that there is a possibility to obtain <br /> the seven feet necessary for the corner lot by including the <br /> adjacent parcel to the north. The applicant has two options. <br /> Number one would be to submit a revised Tentative Map with three <br /> lots. The second option would be to submit a revised Tentative Map <br /> which would include the parcel to the north. <br />
