CONDITIONS OF APPROVAL <br /> MS-92-128 <br /> Ernest Vasti <br /> Unless otherwise specified, all Conditions of Approval shall be compiled with prior to the approval <br /> of the Parcel Map. <br /> This approval will expire three years from the date of approval unless (1) all Conditions of Approval <br /> have been complied with and (2) a Parcel Map has been filed with and accepted by the Surveyor's <br /> Office. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance requirements. Ordinance requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Chandler Martin, 468-3190) <br /> a. All parcels shall have a minimum lot width of 50 feet, measured at the front yard setback <br /> line. (Development Title Section 9-310.4) <br /> b. All parcels shall have a minimum area of 5,000 square feet. (Development Title Section <br /> 9-310.3) <br /> C. The side property lines of Lot 3 shall respect a 5-yard setback from the existing <br /> structures. (Development Title Section 9-310.5) <br /> d. Street trees are required as specified in Section 9-1020.4 of the Development Title. <br /> 2. DEPARTMENT OF PUBLIC WORKS: <br /> (See the attached memo from Public Works dated November 2, 1994.) <br /> 3. PARKS AND RECREATION: <br /> a. The collection of in-lieu fees is required for park development. (County Ordinance No. <br /> 9-1230-8) <br /> 4. COUNTY COUNSEL: <br /> a. Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, <br /> indemnify, and hold harmless the local agency or its agents, officers, and employees from <br /> any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory <br /> agency, appeal board, or legislative body concerning a subdivision, which action is <br /> brought within the time provided for in Section 66499.37 of the Government Code. <br /> NOTE: On November 15, 1994, the San Joaquin County Community Development Department Approved <br /> MS-92-128 subject to the Conditions of Approval listed above. <br />
