CONDITIONS OF APPROVAL <br /> PA-0400789 <br /> Bennett Development <br /> Major Subdivision Application No. PA-0400789 was approved by the San Joaquin County Planning <br /> Commission on August 3, 2006. The effective date of approval is August 13, 2006. This tentative <br /> map approval will expire on August 13, 2009, which is three years from the date of approval, unless <br /> (1) all Conditions of Approval have been complied with and (2) a Final Map has been filed with and <br /> accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be <br /> complied with prior to approval of the Final Map. Those Conditions followed by a Section Number <br /> have been identified as Ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified,and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Kathy Allen, 953-7509) <br /> a. TENTATIVE MAP: The Final Map shall substantially conform with the approved tentative map <br /> dated June 23,2006. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Final Map: <br /> (1) All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniences or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) The average lot size for all lots shall be equal to or greater than 6,000 square feet but not below <br /> 5,000 square feet(Development Title Section 9-310.3[b][1]). <br /> (2) The average lot width for all lots shall be equal to or greater than 60 feet but not below 50 feet, <br /> measured a distance of 20 feet back from the front lot line (Development Title Section 9- <br /> 310.4[a][1]). <br /> d. TREE PRESERVATION: Future development on the parcels shall be consistent with the <br /> requirements of the County's Tree Preservation Ordinance. (Development Title Section 9-1505.2) <br /> (1) No grade changes shall occur within six feet of the trunk of the tree. (Development Title <br /> Section 9-1505(a)[1]) <br /> (2) No grade changes shall occur that entail removing or adding more than six inches of soil in the <br /> protected zone of the tree. (Development Title Section 9-1505(a)[21) <br /> (3) Any grade changes within the protected zone of the tree shall be accomplished so as to prevent <br /> soil compaction and injury to or removal of the tree's roots.
