Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration;and <br /> 2. Approve Use Permit Application No. UP-01-3 with the Findings and Conditions of Approval <br /> contained in the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> The establishment, maintenance, and operation of the use does not conflict with the <br /> General Plan because a mobile home park is consistent with the R/L General Plan <br /> designation and may be conditionally permitted in the R-L zone with an approved Use <br /> Permit. In addition, the development project meets the allowable residential density <br /> requirements of two (2)to six (6) dwelling units per gross acre. (General Plan Volume I, <br /> Residential Development Policy No. I (p. IV-17) and Development Title Section 9-315.3) <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> The City of Stockton has issued a "will serve" letter stating that adequate sanitation <br /> services are available. California Water Services has indicated that it will provide the <br /> water services, and San Joaquin County will provide storm drainage. As a Condition of <br /> Approval, improvements, fees, and dedications will be provided. The proposed utilities, <br /> required improvements, and other facilities are existing or will be provided as reflected in <br /> the approved site and/or improvement plans. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • The property involved is of adequate size and shape to accommodate the proposed use <br /> and all yards, building coverage, setbacks, parking areas, and other requirements of this <br /> Title. The General Plan and zoning designations of R/L and R-L permit 2-6 dwelling units <br /> per gross acre. Therefore, the 14.69 acres proposed is adequate in size to accommodate <br /> seventy-five (75) mobile home units. The site is relatively level, and the site plan <br /> demonstrates that County requirements can be satisfied. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because the Initial Study prepared for this project found no <br /> potentially significant environmental impacts. <br /> San Joaquin County UP-01-31Rolleri <br /> Community Development Page 6 <br />
