facilities constructed as a part of the ESSSP, to be limited to that provided for in the <br /> Amended Engineer's Report of November 6, 1984, except that development of a single- <br /> family dwelling will be allowed for legally established Lots of Record. Additionally, <br /> development within the South Collector System, using facilities constructed as part of <br /> the ESSSP, shall be allowed to a greater density than that provided for in the Amended <br /> Engineer's Report of November 6, 1984, provided the development can be served by the <br /> existing or modified facilities. The burden to show that a development can be served <br /> shall belong to the developer. This modified Resolution did not allow connections to <br /> parcels outside the East Stockton Sanitary Sewer District. <br /> On January 13, 1998, the Board of Supervisors adopted Resolution R-98-25, amending <br /> Resolution R-96-194, to permit development, within the North Collector System, using <br /> facilities constructed as part of the ESSSP, to a greater density than that provided for in <br /> the Amended Engineer's Report of November 6, 1984, provided the development can be <br /> served by the existing or modified facilities. The burden to show that a development can <br /> be served shall belong to the developer. This amendment likewise did not allow <br /> connections.to-parcels outside the East Stockton Sanitary Sewer District. <br /> Since the three resolutions adopted by the Board of Supervisors limited connections to <br /> the East Stockton Sanitary Sewer Project to parcels within the District, the Department <br /> of Public Works recommended a condition which prohibits connection to the ESSSP by <br /> this project, which is located in the South Collector System. This recommended <br /> condition was approved by the Planning Commission on May 17, 2001. <br /> Appeal Statement No. 2: <br /> "Applicant will provide street lighting for the Walker Lane and Horner Lane <br /> frontage; however, different lighting within the project." (Condition 2.n.) <br /> Response to Appeal Statement No. 2: <br /> Department of Public Works Condition 2.n. states: <br /> Street lighting shall be provided for the subdivision and the frontage of Walker <br /> Lane and Horner Lane. (Development Title Section 9-1105.11) <br /> The Department of Public Works has indicated that the lighting requirement applies <br /> strictly to County maintained roads. Roads located within the mobile home park are <br /> considered private and, therefore, are not included in this condition of approval. <br /> FISCAL IMPACT: <br /> None. <br /> BOS LETTER PAGE 5 <br />
