PA-0700469 OF CATHIE LUCKEY (CIO <br /> MICHAEL HAKEEM) (APN: 191-270-28) (ADDRESS: 1481 W MANILA <br /> ROAD, LATHROP) <br /> The applicant has submitted the above referenced Variance application to change the <br /> minimum parcel size from 40 acres in the AG-40 (General Agriculture, 40 acre minimum) <br /> zone to create a 31.8 acre parcel. The underlying application is a Lot Line Adjustment <br /> with the 60 acre parcel to the east to create a 31.8 acre parcel and a 68.2 acre parcel. <br /> i <br /> { The project site is located on the north side of Manila Road, 1,500 feet west of Holmes <br /> Road (north of Lathrop). <br /> I <br /> The property has a General Plan designation of OSIRC (Resource Conservation) and <br /> AIG (General Agriculture) and is zoned AG-40 (General Agriculture, 40 acre minimum). <br /> The Commupity Development Department has reviewed the application and offers the <br /> a following comments: <br /> Variance <br /> A Variance application provides a means of altering the requirements of the Development <br /> Title in specific instances where the strict application of those requirements would deprive <br /> a property of privileges enjoyed by other properties in the vicinity and under identical <br /> zoning because of special circumstances applicable to the property involved. <br /> Developmerit Title Section 9-827 states that prior to approving an application for a <br /> Variance, the Review Authority shall find that all of the following are true: <br /> Finding 1. Because of the special circumstances applicable to the property, including size, <br /> shape, topography, location, or surroundings, the strict application of the regulation <br /> deprives the property of privileges enjoyed by other property in the vicinity and under <br /> identical zoning classification. <br /> 1 <br />
