PA-0700469 OF CATHIE LUCKEY (CIO MICHAEL HAKEEM) (APN: 191-270-28) (ADDRESS: 1481 W MANILA ROAD, LATHROP) The applicant has submitted the above referenced Variance application to change the minimum parcel size from 40 acres in the AG-40 (General Agriculture, 40 acre minimum) zone to create a 31.8 acre parcel. The underlying application is a Lot Line Adjustment with the 60 acre parcel to the east to create a 31.8 acre parcel and a 68.2 acre parcel. i { The project site is located on the north side of Manila Road, 1,500 feet west of Holmes Road (north of Lathrop). I The property has a General Plan designation of OSIRC (Resource Conservation) and AIG (General Agriculture) and is zoned AG-40 (General Agriculture, 40 acre minimum). The Commupity Development Department has reviewed the application and offers the a following comments: Variance A Variance application provides a means of altering the requirements of the Development Title in specific instances where the strict application of those requirements would deprive a property of privileges enjoyed by other properties in the vicinity and under identical zoning because of special circumstances applicable to the property involved. Developmerit Title Section 9-827 states that prior to approving an application for a Variance, the Review Authority shall find that all of the following are true: Finding 1. Because of the special circumstances applicable to the property, including size, shape, topography, location, or surroundings, the strict application of the regulation deprives the property of privileges enjoyed by other property in the vicinity and under identical zoning classification. 1
