I <br /> Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit No. PA-0100102 with the Findings and Conditions of Approval contained in <br /> the staff report.::' <br /> Findings ; <br /> 1. The proposed"use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable <br /> plan adopted`by the County. <br /> This Finding can be made because the establishment, maintenance.;and operation of <br /> a true stop, hotel, auto fuel island, convenience store, and restaurant do not <br /> conflict with the General Plan. The uses proposed in application PA-0100102 are <br /> consistent with the CIFS General Plan designation and may be conditionally <br /> permitted in the C-FS zone.There are no Master Plans,.Specific Plans, Special <br /> Purpose Plans, or any other applicable plans in the vicinity. <br /> 2, Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other <br /> necessary facilities have been provided, and the proposed improvements are properly related to <br /> existing and proposed roadways. <br /> • This Finding can be made because adequate utilities, access roads, sanitation, <br /> drainage and other necessary facilities have been provided and the proposed <br /> improvements are properly related to existing and proposed streets and highways. <br /> Projeets in the C-FS zone may be served by a private septic system, an individual <br /> well, and on-site storm drainage if there are no public facilities available.The City of <br /> Lathrop did not issue will-serve letters for this project. No public services are <br /> available, therefore,the project will be served by a private septic system, an <br /> + individual well, and on-site storm drainage. <br /> Reco,, mended traffic mitigation measures pursuant to Public Works conditions of <br /> approval include: 1) Install "Stop" signs at three intersections (Roth Road at <br /> Manthey Road; Roth Road at 1-5 southbound ramps; and Roth Road at 1-5 <br /> northbound ramps); 2) Fair share amount of$1,148,522.00 for four intersections <br /> (Roth Road at Manthey Road; Roth Road at 1-5 southbound ramps; Roth Road at 1-5 <br /> northbound ramps; and Roth Road at Harlan Road); 3) Install "Pedestrian Crossing" <br /> signs and striped crosswalk legends (Manthey Road adjacent to the onsite "Access <br /> Road?�intersection); and 4)Apply for a "No Parking"zone along the westerly <br /> extension of Roth Road. <br /> 3, The site is physically suitable for the type of development and for the intensity of:development. <br /> This Finding can be made because the site plan demonstrates that the flat, 11.4-acre <br /> property is of adequate size and shape to accommodate the proposed uses and all <br /> San Joaquin County-•i PA-08001021Kelly <br /> Community Development Page 8 <br /> 1 <br /> a <br />
