On <br /> September 30, 2010, both Dalwinder Dhoot and the City of Lathrop appealed the <br /> Planning Commission's approval. Since that time, the applicant has been working with <br /> the City of Lathrop toward a solution whereby the City of Lathrop has accepted the <br /> current traffic study and the conditions of approval from-this Use Permit as approved by <br /> the Planning Commission and the applicant has agreed to annex to the City. A copy of <br /> the agreement is attached. The City is no longer asking for a"fair share" for the <br /> relocation of the Roth/Manthey Road intersection and has withdrawn its appeal. <br /> This is an appeal by Dalwinder Dhoot of the Planning Commiss'ion's approval of a Use <br /> Permit application for a truck stop, hotel, convenience stores with automobile fuel <br /> islands, and a full-service restaurant to be built in three phases on Manthey Road at the <br /> west terminus of Roth Road, near Lathrop. <br /> On January 9, 2007, the Board of Supervisors approved General Plan Map Amendment <br /> No. PA-0600037 to change the designation of an 11.4-acre parcel from General <br />
