If Kelley, succeeds in obtaining STAR route approval for Roth between 1-5 and the KSC site, City <br /> agrees to allowing Kelley to install appropriate signage subject only to meeting STAA requirements. <br /> 6. Kelley Not Required to Complete_Additional CEQA Documents. The City shall not <br /> require the owners to prepare any additional CEQA documents for the Project. Instead, the City shall <br /> incorporate all of the environmental studies and .mitigation measures previously provided to and <br /> approved by San Joaquin County for the Project, including, but not limited to its Mitigated Negative <br /> Declaration,Traffic Study,Soil Suitability Study, Noise Study, and Air Pollution study and report. <br /> 7. City Waiver .of Administrative and Annexation Fees. The City will waive any City <br /> annexation fees and any City administration fees related to the annexation and the Project. Such waiver <br /> does not extend, however, to the traffic mitigation fees detailed in paragraph 1 above nor does such <br /> waiver extend to other fees included in the fee estimate attached hereto as Exhibit "C', which are <br /> subject to modification and potential escalation until such a time as they are fixed by a development <br /> agreement or paid. <br /> 8. CitDoes Not Waive_Fees_Due to Third Parties. The City does not waive any fees Kelley <br /> owes or will owe to non-City agencies, including the County of San Joaquin and LAFCO. Fees to such <br /> third parties will be paid by applicant. <br /> 9. Kelley agrees to pay for sewer capacity. The Project, as approved by the County Use <br /> Permit, requires 62 ISU of sewer capacity. Kelley is hereby provided a right of first refusal ("RFR") to <br /> purchase the required ISUs beginning on the effective date of this settlement agreement and continuing <br /> for a period to 6 months to allow Kelley to submit a completed annexation application to the City and <br /> allow LAFCO to take action on said application. If another entity desires to purchase all or any portion of <br /> the Required ISUs. during the effective period of the RFR, the City shall provide Kelley Notice and Kelley <br /> will have 10 days to reserve the required ISUs by delivering to the City a deposit equal to 100 of the <br /> total cost of the required ISUs with the remaining 90% due 5 days after annexation action by LAFCO or <br /> 30 days after approval of the Wastewater Capacity Sale Agreement by the Council, whichever is later. <br /> Kelley's RFR shall terminate 6 months after the effective date of this settlement agreement if <br /> Kelley fails to submit a completed application for annexation to the City during those 6 months or, if <br /> annexation application is timely submitted, then the RFR shall terminate 5 days after a decision is <br /> rendered by LAFCO on Kelley's annexation application (or date annexation application is withdrawn.) <br /> The cost of the sewer capacity will be paid by Kelley and Kelley will not receive any reimbursements or <br /> credits for such payment. <br /> The sewer capacity fees are those fees owed to the Sewer district (ISU fees). The sewer usage <br /> fees are the monthly fees charged for sewage discharge using the City's standard formulas/calculations. <br /> The sewer connection fee is as shown under Capital Facility Fees, North Harlan Road Improvement <br /> District, New Development, Sewer Collection System in the current City of Lathrop Master Fee Schedule. <br /> The fee is based on the water meter size(s). The sewer connection fee normally attributable to Kelley's <br /> project will be waived, up to a maximum of the total sum of the sewer connection fee, in exchange for <br /> Kelley installing the sewer line extension. <br /> 4 <br />
