PUBLIC HEARING OPENED: PROPONENTS: Howard Seligman, representing the applicant, said they support the recommendations made by staff. A full EIR is not required by staff. Mitigation measures are required. He does not agree with the city of Lathrop that an EIR is required. Their position is just based on opinion and not on fact. This project has been in the works for 5 to 6 years. The applicant requested services from Lathrop but was told the applicant would have to build them. Lathrop did not object to the General Plan and Zone Reclassification change. The applicant would like to annex to Lathrop for water and sewer. He is opposed to the condition required by Lathrop. He did not receive a copy from the city. He asked staff to provide him a copy. There were no specific plans from the city about any future improvements. Chuck McCallam, the project engineer, said he studied the improvements for Roth Road. These improvements would also benefit Lathrop. Jeff Martini said he is in favor of the project. It would bring in more jobs. OPPONENTS: Charlie Mullen, representing the City of Lathrop, said the city supports the project but it does not provide full mitigation for traffic impacts on the city. He requested an EER instead of a Negative Declaration. Tom Ruark,with the city of Lathrop,said money should be provided for the relocation of the roads. Dal Winder Dhoot said he is not in opposition, but the roads need to be realigned. A full ElR needs to be done. REBUTTAL: Howard Seligman said the city does not speak for Caltrans. The applicant needs to obtain a permit from Caltrans. The applicant will be required to do improvements on Roth Road. The applicant does not have to mitigate future interchange improvements. They will contribute their fair share for traffic improvements. PUBLIC HEARING CLOSED: Commissloner Villapadua said the city is not opposed, but they are concerned about traffic and the roads.
