We have a general concern and disagreement with the recommended traffic impact mitigation to <br /> use 4-way stop controlled intersections and believe that signalized intersections are warranted and <br /> necessary td properly address the LOS conditions. <br /> The City of Lathrop did not submit any data to support their general concern and disagreement. <br /> The traffic studydetermined that stop-controlled intersections were adequate. <br /> 5. We have a g' neral concern that the payment of traffic fees are not specified to go'.directly to the <br /> local jurisdiction, in this case the City of Lathrop, as we are the agency that is directly responsible <br /> for the local road network improvements(i.e. Roth Road). <br /> The Department"of Public Works monitors the funding for individual intersections.The funds <br /> will be allocated-to whichever jurisdiction improves the intersection(s). <br /> 6. The proposed_approach to mitigating traffic impacts does not appear to be consistent with State law <br /> and mitigatiA practices. If the project is unable to fully mitigate the LOS Conditions by constructing <br /> the necessary' roadway improvements at this time, then the project would appear to trigger the need <br /> for an Environmental Impact Report and make Findings of Overriding Consideration. <br /> The traffic studjr determined that stop-controlled intersections and fair-share payments are the <br /> appropriate mitigations. <br /> C)i 7. The summary discussion does not mention or address the fact that this site is located in the City of <br /> Lathrop Sphgre of Influence(SOI). It is the City of Lathrop's desire and request to San Joaquin <br /> County that 411 lands located within the City of Lathrop SOI be annexed into the City of Lathrop, be <br /> developed under our jurisdiction and be developed to the City of Lathrop standards and regulations. <br /> We are concerned that a San Joaquin County approval of this and/or other development <br /> applications located in our SOI will make it more difficult in the long run for such properties to annex <br /> ` into and be serviced by the City of Lathrop. . <br /> We are concerned that the City of Lathrop development standards and infrastructure and utility <br /> services improvement are not being addressed, and in the long run this will diminish the City of <br /> Lathrop's abj ty to provide services to such properties. <br /> The City of Lathrop was sent a referral on March 28, 2008 and again on December 11, 2009 <br /> because the,project area lies within the City's sphere of influence.The applicants have <br /> requested to be annexed to the City and to public services. However,the City of Lathrop has <br /> not given a timeline for annexation and has denied connection to public services. Although <br /> this project,i5 in the Lathrop Sphere of Influence,County requirements apply.
