Notification and CEQA <br /> The Initial Study was.sent to the Clearinghouse and posted on December 22, 2009,with a review period <br /> from December 22, 2009, to January 20, 2010. The Initial Study has been available since that time, and <br /> Caltrans and the City'of Lathrop have commented on the project. The traffic study is dated July 31, 2009. <br /> The noise study is dated July 15, 2009. The Initial Study, which includes mitigation from the traffic and <br /> noise studies, has begin available for review by the public since December 22, 2009. <br /> The City of Lathrop has reviewed the Initial Study and the traffic study for this project. Their comments are <br /> below. All potentially,".significant environmental effects have been reduced to a level of less than significant <br /> with the inclusion of the recommended mitigation measures from the traffic study and the noise study. <br /> Therefore, the Comm".Unity Development Department has determined that a full EIR is not required. <br /> Public Utilities =ti <br /> A single parcel in the-,C-FS zone over two acres in size may be developed with a private septic system <br /> (Development Title Section 9-1105.3[b]), an individual well (Development Title Section 9-1120.3[c], and on <br /> site storm drainage(bevelopment Title Section 9-1135.3[b]). The applicants would connect to the City of <br /> Lathrop for sewer, water, and terminal drainage if it were available. However, the City of Lathrop does not <br /> want to annex the area at this time or provide the services. <br /> Traffic <br /> The applicant is resp`dnsible for traffic issues related to this project, including the Manthey Road and Roth <br /> Road intersection. Caltrans will provide any solution to the area wide traffic issues regarding freeway <br /> interchanges. Traffic,Mitigation for the project, as determined by the Department of Public Works, includes a <br /> 4-way"Stop" sign and;a fair share payment of$610,036;04 for the intersection of Manthey Road and Roth <br /> Road. <br /> A i= <br /> The traffic study did.rt require the installation of a signal for northbound 1-5 traffic at Roth Road. A"Stop" <br /> sign is required and affair share payment of$111,808.00 towards the construction of four intersections <br /> pursuant to the Publid Works Department conditions of approval. <br /> Farming <br /> The uses approved by this project will be contained to the subject parcel and the adjacent County roads. <br /> The parcel is zoned C-FS. A truck stop, auto fuel island, restaurants, and hotel may be conditionally <br /> permitted in the C-FS'zone with an approved Use Permit application. The truck stop with truck parking will <br /> be the only use adjacent to any current agricultural use and it will be contained on the western portion of the <br /> parcel. The auto fuel lSland, restaurants, and hotel will be on the eastern portion of the parcel, adjacent to <br /> Manthey Road. There is a right-to-farm ordinance whereby the County of San Joaquin recognizes and <br /> supports the right to:farm agricultural lands in a manner consistent with accepted customs, practices, and <br /> standards. The neighboring parcel has frontage on a County maintained road and has a General Plan <br /> designation of Limited Industrial. The project parcel has a General Plan designation of Commercial <br /> Freeway Service.
