CY <br /> LJ <br /> Analysis <br /> Background <br /> On July 26, 2001, the Community Development Department approved Site Approval Application No. SA-01- <br /> 0017 for the construction of a personal storage facility. <br /> On August 7, 2003, the Community Development Department approved Site Approval Application No. PA <br /> 0300224 for one monument sign apd one.pole sign for:the personal storage facility. <br /> On July 7, 2004 the pole sign for the personal storage facility was completed. <br /> On March 15, 2005,the Community Development Department approved Site Approval.Application No. PA- <br /> 0500031 for one 50 foot tall off-premises sign. The constructiop for the sign was completed on.September 9, <br /> 2005. Once the sign was built,the applicants realized that their sign was not visible for northbound travelers <br /> on 1-5. <br /> policy Considerations <br /> Development Title Section 9-827.1 states that a Variance application provides a means of altering the <br /> requirements of the Development Title in specific instances where the strict application of those <br /> requirementswould deprive a property of privileges enjoyed by others in the vicinity and under identical <br /> zoning because of special circumstances applicable to the property involved..For a Valance application.to <br /> be approved, three Findings for a Variance(included in the staff report) must be made in the affirmative. <br /> The Community Development Department has determined that all three Findings can be made in the <br /> affirmative. <br /> Finding No. 1. <br /> Finding No..1 (Special Circumstances): Because of the special circumstances applicable to the property, <br /> including size, shape, topography, location, or surroundings, the strict application of the regulation deprives <br /> the property of privileges enjoyed by other property in the vicinity and under identical zoning classification. <br /> The applicant states that"the current on-site sign for Silver Chase Storage blocks a clear view of the off- <br /> premise sign. Approval of the Variance would give clear visibility for viewing of advertising for both <br /> businesses." The applicant also states that"the billboard is 15 feet shorter than surrounding billboards. It <br /> gives a roller coaster effect of billboards as we look down the freeway because it does not conform to the <br />` other 65 foot billboard heights already granted on Interstate 5." <br /> This finding can be made because the on-site sign blocks the view of the billboard for northbound travelers. <br /> The freeway grade is approximately 15 feet higher than the grade for the existing sign. Limiting this <br /> billboard to 50 feet denies the property owner of a privilege enjoyed by other property owners in the vicinity. <br /> The other billboards in the area have a clear view. The County approved Variance PA-0400278 for a height <br /> increase to 65 feet because trees blocked the view of the billboard. The other off-premises signs in the <br /> vicinity are within other jurisdictions but they appear to be taller than fifty feet. The billboard on the east side <br /> of the freeway appears to be much taller than this sign. The City of Lathrop permits highway oriented signs <br /> up to 85 feet.
