That memorandum contains a request <br /> that a septic tank usage/Nitrate Loading Study be performed, a soils analysis be prepared,and a <br /> groundwater study be completed. Some of these requirements are authorized by the Development Title, <br /> but most of them are not. <br /> Given the history of this project,we feel that your requirements are excessive,and would request <br /> that you reconsider your position. As you may be aware,my clients purchased this property based on the <br /> repeated representations(both orally and in writing)that the zoning on the property was I-W. It was only <br /> much later,after they purchased the property,that they learned that the property was in fact zoned AG-40. <br /> County Staff has initiated this application in an attempt to determine if the Planning Commission and the <br /> Board of Supervisors will rectify this situation in lieu of other options, including litigation. <br /> I would be happy to discuss this with you in more detail. Please give me a call when you get a <br /> chance.
