SAN JOAQUIN HAZARDOUS MATERIALS INFORMATION GUIDE <br /> The following are guldelincs to help building permit applicants and business license applicants <br /> determine whether they nced to comply with the hazardous materials reporting requirement of <br /> Chapter 6.95 of the California Health and Safety Code. <br /> Chapter 6.95 requires businesses which handle hazardous materials, at the California Threshold <br /> Planning Quantities,to file a'Hazardous Materials Management Plan (HMMP)'with the Administering <br /> Agent In San Joaquin County, the Office of Emergency Services has been appointed to the Local <br /> Administering Agency Businesses that handle Acutely Hazardous Materials will also be required to <br /> file an Acutely Hazardous Materials Registration Form and possible complete a Risk Management and <br /> Prevention Program (RMPP). <br /> GUIDELINES: <br /> 1. WIII the owner or future building applicant handle a hazardous material or a mixture <br /> containing hazardous material In a quantity equal to or greater than 55 gallons, 500 pounds, <br /> or 200 cubic feet at any one time? <br /> . IF 'YES' THEN THE OWNER OR FUTURE OCCUPANT MUST MEET THE <br /> REOUIREME:NTS OF CHAPTER 8.35,SECTION 25505 OF THE HEALTH AND SAFETY <br /> CODE PRIO13 TO ISSUANCE OF A CERTIFICATE OF OCCUPANCY. <br /> 2. WIII the owner or future building occupant handle an Acutely Hazardous Material listed In the <br /> attached Appendl)O <br /> . IF 'YES' THEN THE OWNER OR FUTURE OCCUPANT MUST MEET THE <br /> REQUIREMENTS OF CHAPTER 8.95, SECTIONS 25 AND 25534 PRIOR TO THE <br /> ISSUANCE OF A CERTIFICATE OF OCCUPANCY. <br /> 3. WIII the proposed b illding or modified facility be within 1,000 feet of the outer boundary of <br /> a school (grades K-12) and have Acutely Hazardous Materiels? <br /> . IF 'YES' TO BOTH CONDITIONS, THEN THE OWNER MUST MEET THE <br /> REQUIREMENTS OF CHAPTER 6.95, SECTIONS 25533 AND 25534 PRIOR TO <br /> ISSUANCE OF A BUILDING PERMIT. <br /> IF FUTURE OCCUPANT IS UNKNOWN AT THIS TIME: <br /> The fact that the building far which the permit Is being applied does not have a tenant at this time <br /> does not relieve the owner or his authorized agent from the responsibility under California law. The <br /> owner or authorized agent must Indicate whether future occupants will need to comply with the <br /> reporting requirements for she handling of any hazarodus materials. <br /> If at a later date the applicant determines that a tenant will be handling hazardous materials, the <br /> applicant must Inform the office of Emergency Services.
