CONDITIONS OF APPROVAL PA-0500108 Northbrook Properties, Inc. Site Approval Application No. PA-0500108 was approved by the San Joaquin County Community Development Department on April 19, 2005. The effective date of approval is April 29, 2005. This approval will expire on October 29, 2006, which is 18 months from the effective date of approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits have been secured and remain in force, and (3) all necessary permits from other agencies have been secured and remain_in farce: Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled prior to the establishment of the use and the issuance of any building permits. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance requirements may apply. 1. OINNLUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Rick Griffin, [209] 468-3154) a. BUILDING PERMIT: Submit an "APPLICATION-COMMERCIAL BUILDING PERMIT'. The Site Plan required as a part of the building permit must be prepared by a registered civil engineer or licensed architect. This Plan must show drainage, driveway access details including gates, on-site parking, landscaping, signs, existing and proposed utility services, and grading (refer to the "SITE PLAN CHECK LIST' for details). A fee is required for the Site Plan review. (Development Title Section 3884) b. APPROVED USE: This approval is for a 78-foot tall wireless telecommunications stealth monopole and related equipment as shown on the Site Plan dated February 23, 2005. (Use Type: Communications Services-Type II) c. STORM DRAINAGE: Any additional stormwater drainage created by new improvements shall be retained on-site. The drainage pattern and corresponding storm drain improvements shall be shown on the Site Plan. Drainage calculations prepared by a registered civil engineer or architect shall be included. (Development Title Section 9-1135) d. SETBACKS: The structure shall comply with the following setback requirements: (1) The proposed tower and accompanying equipment shelter shall be set back a minimum of 20 feet from the front and street side yard property lines. (Development Title Section 9-410.5) (2) New freestanding support structures shall be located a distance equal to at least the height of the said structure from residential structures on adjoining properties. (Development Title Section 31065A[d]) e. MAINTENANCE OF FACILITIES: All freestanding structures, antennas, and supporting equipment associated with wireless telecommunication shall be maintained in good condition by the provider of the telecommunication facility and, whenever necessary, repaired or replaced.
