CONDITIONS OF APPROVAL PA-0600655 Baker Site Approval Application No. PA-0600655 was approved by the San Joaquin County Planning Commission on March 15, 2007. The effective date of approval is March 25, 2007. This approval will expire on September 23, 2008, which is 18 months from the effective date of approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits have been secured and remain in force, and (3) all necessary permits from other agencies have been secured and remain in force. Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled prior to the establishment of the use and the issuance of any building permits. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Corinne King, [209] 953-7509) a. APPROVED USE: This approval is for a private right-of-way access to one lot (Lot 87) in the Small Farms Improvement Tract Division "C" antiquated subdivision as shown on the Site Plan dated December 6, 2006. 2. PUBLIC WORKS DEPARTMENT (Seethe attached memo dated February 6, 2007) a. An encroachment permit shall be required for work within the road right-of-way. (Development Title Section 9-1145.5) b. The owner shall execute an Irrevocable Offer and Agreement to Dedicate Road to result in a 25-foot- wide right-of-way from the centerline of Mayers Road to the property line across the property's frontage. A$615.00 fee currently is required for processing, per Development Title Table 9-240.2, in addition to a copy of the Grant Deed and a legal description of the parcel to be offered for dedication. The fee due will be based on the current fee schedule. (Development Title Section 9-1150.5) c. The frontage improvements for Mayers Road shall be constructed in conformance with the standards for one-half of a 50-foot-wide right-of-way rural residential street prior to finalization of the Site Approval. (Development Title Section 9-1150.2) NOTE: Any construction activity that results in the disturbance of at least one acre of soil shall require a State NPDES construction permit. In a Rural Residential roadway, an A.C. dike shall be prohibited, and the shoulder width shall be six feet. Maintenance of the private road shall be per Civil Code 845. 3. ENVIRONMENTAL HEALTH DEPARTMENT(Staff Contact: Lisa Medina, 468-3455) a. Environmental Health requires a soil suitability study indicating that the area is suitable for septic system use. This must be performed prior to issuance of building permits (Development Title Section 9-1105.2[d]). A review fee of$190.00 must be paid at the time of submittal to Environmental Health.
