CONDITIONS OF APPROVAL <br /> PA-03-346 <br /> Gilbeau, et al <br /> Minor Subdivision Application No. PA-03-346 was approved by the San Joaquin County Community <br /> Development Department on September 24, 2003. The effective date of approval is October 4, 2003. <br /> This tentative map approval will expire on October 3, 2006, which is three years from the effective <br /> date of approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map <br /> has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Jose Rubianes, 953-7509) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved Revised Tentative <br /> Map#2 dated September 12, 2003. <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All numbered parcels shall have a minimum lot width of three hundred and thirty (330) feet, <br /> measured at the front yard setback line (does not apply to remainder). (Development Title <br /> Section 9-610.4) <br /> (2) All numbered parcels shall have a minimum lot area of twenty (20) gross acres. (Development <br /> Title Section 9-610.2) <br /> c. ACCESS: The following access requirements apply and shall be shown on the Parcel Map: <br /> (1) A proposed 25-foot wide private easement for access to Parcel One, along the west side of <br /> Parcel Two, shall be shown on the Parcel Map. (Development Title Section 9-1150.15) <br /> (2) The following note shall be placed on the Parcel Map and also shall be recorded as a separate <br /> instrument: <br /> A. At the time of development of Parcel One, the entire length of the private right-of-way for <br /> Parcel One shall be constructed and maintained to the standards required by Section <br /> 10.207 of the Uniform Fire Code and applicable San Joaquin County Improvement <br /> Standards. (Development Title Section 9-1150.15[c]) <br /> 2. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision, which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br /> Conditions of Approval 1 - PA-03-346 <br />
