CONDITIONS OF APPROVAL <br /> GX-96-6 <br /> GREG BURGIN, ET AL <br /> Agricultural Excavation Aoplication No.GX-96-6 was approved by the San Joaquin County Community <br /> Development Department on November 26, 1996. The effective date of approval is December 6, <br /> 1996. This approval will expire on June 7, 1998, which is 18 months from the effective date of <br /> approval, unless (1) all Conditions of Approval have been compiled with and (2) all necessary permits <br /> from other agencies have been secured and remain In force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use. Those Conditions followed by a Section Number have been <br /> Identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Chandler Martin, 468-3190) <br /> a. MODIFICATIONS TO PLAN: The following modifications shall be made to the Plan and shown <br /> on the required Grading Plan/Improvement Plan: <br /> (1) The 1.5-foot undercuts shown for field 4 of phase I shall be scaled and identified as 2.0 <br /> feet. (The Plan graphic indicates 1.5 and scales out to 1.0. However, note 5 states that <br /> the thickness of topsoil will be 2.0 feet below the finished grade. 1.5 feet of topsoil will <br /> come from fields 1 and 3; .5 feet of topsoil will come from the top of field 4.) <br /> (2) The undercut graphic for phase II (cross section cut B-8) shall be changed from 3.5 feet <br /> to 2.0 feet, reducing the volume of the excavation by 1.5 X (25.8/2)(43,560/27)= 31,218 <br /> cubic yards. The stockpile required for phase II is also reduced accordingly. See <br /> Condition 'd,' 'Replacement of Topsoil.' This reduction of undercut is required because <br /> undercuts in excess of 2.0 feet do not improve the agricultural viability of the property. <br /> b. WRITTEN NOTIFICATION/GRADINGPLAN/IMPROVEMENTPLAN: Awrittennotification ofwork <br /> schedules and a Grading P!an/Improvement Pian shall be provided by the applicant and approved <br /> by the County prior to any grading or excavation. The Grading Plan/Improvement Plan shall <br /> reflect all of the adopted Conditions of Approval. One (1) copy of the Grading Plan/Improvement <br /> Plan shall be submitted to the Development Services Division for distribution to the involved <br /> County departments. A plan check fee will be required. The Grading Plan/Improvement Plan will <br /> not be approved until all the performance guarantee and the work schedule are submitted. <br /> Approval of the Grading Plan/Improvement Plan shall mark the beginning date of the Excavation, <br /> see Condition Y,' 'Permit Expiration.' (Development Title Section 9-1410.30]) <br /> C. PERFORMANCE GUARANTEE: To insure that the excavation is completed in conformance with <br /> the approved permit, the operator shall secure a performance bond or other financial security <br /> sufficient to cover the cost of rehabilitation of the site for agricultural use. The form of the bond <br /> or other financial security shall be found acceptable by Community Development Department and <br /> County Counsel. The performance guarantee may be submitted for each phase separately.
