GROUNDWATER CONDITIONS: The excavation shall not extend to depths below the <br /> groundwater level of the uppermost aquifer. (Development Title Section 9-1415.3[u]) <br /> r. CULTURAL RESOURCES: The excavator shall ease all construction and excavation <br /> work immediately upon the discovery of cultural resource materials. Such work shall <br /> cease until the excavator has complied with the requirements of Appendix K of the CEQA <br /> Guidelines. <br /> S. NOISE: The excavator shall implement the following measures to reduce the impact of <br /> construction-related noise: <br /> (1) All equipment shall have sound control devices no less effective than those <br /> provided on the original equipment. No equipment shall have exhaust systems <br /> without mufflers. <br /> t. LANDSCAPING AND SCREENING: The Landscaping/Screening Plan requirement shall <br /> be considered satisfied by planting corn or other similar height crop to screen the <br /> excavation from McDonald Road and Davini Road. INDEMNIFICATION: The owner shall defend, indemnify, and hold harmless the local <br /> agency or its agents, officers, and employees from any claim, action, or proceeding <br /> against the local agency or its agents, officers, or employees to attack, set aside, void, or <br /> annual an approval of the local agency, advisory agency, appeal board, or legislative <br /> body concerning this quarry excavation permit. <br /> 2. DEPARTMENT OF PUBLIC WORKS: (Staff Contact: Gabe Karam, 468-3000) <br /> a. The excavation plan shall be prepared by a Registered Civil Engineer or Land Surveyor <br /> and include the following: <br /> (1) Detail of access road (first 100 feet from McDonald Road shall be paved). <br /> (2) Haul route. <br /> (3) Stockpile area for topsoil (no excavation or stockpile shall be allowed within 25 <br /> feet of road rights-of-way). <br /> b. Loads on all public roads shall be restricted to legal loads only. (Street and Highway Title <br /> Section 10-2350) <br /> C. A video tape of road conditions on McDonald Road and along the haul route is required <br /> prior to the start of excavation. The condition of McDonald Road and other roads along <br /> the haul route shall be reviewed with the Department of Public Works prior to the start of <br /> excavation.
