Construction and other improvements shall not be permitted within the areas of dedication along the Mokelumne River and from McIntire Road to the river. A note to that effect shall be included in the Habitat Management Plan and on the Final Parcel Map. ORDINANCE REQUIREMENTS: The Ordinance Requirements listed below have been identified as pertinent to this project. Other Ordinance Requirements may also apply. Ordinance Requirements are not appealable. 16 . The minimum parcel size for parcels created by this subdivision shall be forty (40) acres. 17 . The minimum lot width for parcels created by this subdivision shall be one hundred (100) feet. 18 . The provisions of the Flood Prevention Ordinance (Section 9- 10325 of the Planning Title) shall be applied to all construction proposed within the 100-Year Flood Zone. 19 . The owner shall execute an Irrevocable Offer to Dedicate a one hundred (100) foot wide strip along the north property lines of all parcels adjoining the Mokelumne River in favor of San Joaquin County for the purpose of future public use of the Mokelumne River. The area to be dedicated shall be shown on the Final Parcel Map and the Habitat Management Plan. The owner shall execute an Irrevocable Offer to Dedicate a one hundred (100) foot wide strip from the end of Mc Intire Road to the required river dedication in favor of San Joaquin County for the purpose of future public access to the Mokelumne River. The Offer shall only be taken in the event of loss of public access to the Mokelumne River through the Van Assen Park Facility without other alternate access being available. The area to be dedicated shall be shown on the Final Parcel Map and the Habitat Conservation Plan. 20. The expiration date for the approved map shall be twenty-four (24) months from the effective date of Minor Subdivision Application No. MS-90-79 . RL:KA
