Mr. Richard Larrouy 3 <br /> The Service recommends the following actions be undertaken to avoid potential <br /> adverse impacts to the vernal pools and the two vernal pool fairy shrimp: <br /> 1) No recontouring or regrading should occur within the vernal pool <br /> watershed. Any activities that adversely impact the pool hydrology <br /> should be avoided. <br /> 2) The dirt road that passes through the vernal pools should be rerouted to <br /> the top or to the northside of the hill located just north of the <br /> watershed. The road should be designed and constructed to avoid adverse <br /> impacts to the hydrology of the pools. <br /> 3) Use of the vernal pool watershed by off-road vehicles (ORVs) , cattle and <br /> other livestock should be prohibited. Low impact activities such as <br /> bird watching, hiking, picnicking, etc. should be encouraged as an <br /> alternate use. <br /> 4) Septic systems and leach lines should be designed and placed so they do <br /> not adversely impact the water quality of the vernal pools. <br /> 5) Use of herbicides, insecticides, and pesticides should be prohibited <br /> within the vernal pool watershed. <br /> 6) We encourage collection of an annual homeowner's association fee as <br /> mentioned on page 6 of the Revised Initial Study by the County of San <br /> Joaquin to support an annual inspection and preparation of a compliance <br /> report by a qualified biologist. The biologist utilized should be <br /> subject to the approval of the Service. Sufficient funds should be <br /> included in the association fee to insure adequate surveys that are <br /> subject to the approval of the Service each year. We also recommend <br /> that if any damage or destruction occurs, the specific site be restored <br /> to pre-project conditions subject to the approval of the Service and the <br /> California Department of Fish and Game. The recommendations in this <br /> letter should be included in the Declaration of Convenants, Conditions <br /> and Restrictions (CC&Rs) that is submitted for approval to the <br /> California Department of Real Estate (CDRE) .
