Mr. Richard Larrouy 3
The Service recommends the following actions be undertaken to avoid potential
adverse impacts to the vernal pools and the two vernal pool fairy shrimp:
1) No recontouring or regrading should occur within the vernal pool
watershed. Any activities that adversely impact the pool hydrology
should be avoided.
2) The dirt road that passes through the vernal pools should be rerouted to
the top or to the northside of the hill located just north of the
watershed. The road should be designed and constructed to avoid adverse
impacts to the hydrology of the pools.
3) Use of the vernal pool watershed by off-road vehicles (ORVs) , cattle and
other livestock should be prohibited. Low impact activities such as
bird watching, hiking, picnicking, etc. should be encouraged as an
alternate use.
4) Septic systems and leach lines should be designed and placed so they do
not adversely impact the water quality of the vernal pools.
5) Use of herbicides, insecticides, and pesticides should be prohibited
within the vernal pool watershed.
6) We encourage collection of an annual homeowner's association fee as
mentioned on page 6 of the Revised Initial Study by the County of San
Joaquin to support an annual inspection and preparation of a compliance
report by a qualified biologist. The biologist utilized should be
subject to the approval of the Service. Sufficient funds should be
included in the association fee to insure adequate surveys that are
subject to the approval of the Service each year. We also recommend
that if any damage or destruction occurs, the specific site be restored
to pre-project conditions subject to the approval of the Service and the
California Department of Fish and Game. The recommendations in this
letter should be included in the Declaration of Convenants, Conditions
and Restrictions (CC&Rs) that is submitted for approval to the
California Department of Real Estate (CDRE) . A copy of the CC&R and the
final homeowner's association budget that is approved by the CDRE should
be sent to the Service.
Please contact Chris Nagano or Laurie Simons at 916/978-4866 (endangered
species) or Cay Goude at 916/978-4613 (other fish and wildlife) if you have
any questions about this response.
Sincerely,
J/Y Wayne S. White
V Field Supervisor
