ATTACHMENT"A"
FINDINGS FOR WILLIAMSON ACT CONTRACT CAN
-
1.- . . 'That the cancellation is consistent with the, purposes of the.Williamson Act.
a. The,cancellation is for.land on which a Notice.of Nonrenewal has been served
pursuant to Section 51245`of the Government.Code:
This subfinding can,be made because the Commnui, ityZeyelopment
Department approved a Notice of Nonrenewal on February 95, 20K
b. The-cancellation is not likely to result in the removal bf adjacent lands from
agricultural use.
This sub#indirig, can'be made because the property to the east of
.this site isnot under contract and only 4.458 acres of land is to
i come out of contract.
t
c. The cancellation is for an alternative use which is consistent with the applicable
provisions of the County General Plan.
i This subfinding can be made because the cancellation is to facilitate a Lot
I Line Adjustment to move a property line that intersects an existing
M agricultural building. An agricultural building is a permitted use in the AG-40
zone, and is consistent with the AIG (General Agriculture) General Plan.
d. The cancellation will not result in discontiguous patterns of urban development.
This subfinding can be made because this cancellation is only to
move a property line around an existing agricultural building and will
not result in any urban development.
e. There is no proximate noncontracted land which is both available and suitable for the
use which is proposed the contracted lad be out, or, development of the contracted
land would provide more contiguous patterns of urban development than development
of proximate non-contracted land.
This subfinding can be made because the agricultural building is existing and a
portion of the building is on property under contract.
