CONDITIONS OF APPROVAL MS-93-135 VINCENT LODUCA Unless otherwise specified, all Conditions of Approval shall be complied with prior to the approval of the Parcel Map. This approval will expire three years from the date of approval unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed with and accepted by the Surveyor's Office. Those Conditions followed by a Section Number or other Statutory Requirement are based on Ordinance requirements. Ordinance requirements cannot be modified. 1. COMMUNITY DEVELOPMENT DEPARTMENT: a. Parcel 1 shall contain at least five (5) acres gross. (Development Title Section 9-610.2) Parcel sizes shall be shown on the Parcel Map. b. The minimum width of Parcel 1 shall be 200 feet. (Development Title Section 9-610.4) Parcel widths shall be shown on the Parcel Map. C. Provisions for storm water drainage on Parcels 1 and 2 shall be consistent with Section 9-1135.9 of the Development Title. 2. DEPARTMENT OF PUBLIC WORKS: See attached memo dated August 23, 1994. 3. PUBLIC HEALTH SERVICES: See attached memo dated August 8, 1994. 4. PARKS AND RECREATION: See attached letter dated August 2, 1994. 5. SAN JOAQUIN VALLEY UNIFIED AIR POLLUTION CONTROL DISTRICT: See attached letter dated August 19, 1994. 6. COUNTY COUNSEL: a. Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision, which action is brought within the time provided for in Section 66499.37 of the Government Code.
