CONDITIONS OF APPROVAL <br /> PA-1000205 <br /> Cooper Out West <br /> Lot Line Adjustm6ht Application No. PA-1000205 was approved by the San Joaquin County <br /> Community Development Department on September 28, 2010, which is the effective date of <br /> approval. <br /> Unless otherwise specified, all Ordinance requirements shall be compiled with prior to approval of a <br />` Notice of Lot Line Adjustment. <br /> This approval will expire on March 29, 2012,which is 18 months from the effective date of approval, <br /> unless a Notice of Lot line Adjustment has been recorded and a Record of Survey has been filed, if <br /> required by the Land Surveyor's Act. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Contact Staff: John L. Funderburg, 468-3160) <br /> a. APPROVAL; This approval is for a Lot Line Adjustment between two parcels as shown on the site <br /> plan dated August 24, 2010.. <br /> b. NOTICE OF'-OT LINE ADJUSTMENT: A"Notice of Lot Line Adjustment' shall be recorded prior to <br /> conveyance of property through deeds by the owner. Legal descriptions of the resultant properties <br /> shall be submitted to the Surveyor's Division for review and forwarding to the Community <br /> Development: Department. The legal descriptions shall be prepared, stamped and signed by a <br /> Registered Civil Engineer, qualified to practice -Land Surveying per Section 8731 of the Land <br /> Surveyors'Act, or a Licensed Land Surveyor. (Development Title Section 9-872.4) <br /> c. WILLIAMSO�N ACT CONTRACT: The property owner shall rescind the current contracts and shall <br /> enter into neuvr contracts prior to recording the Notice of Lot Line Adjustment. The Notice of Lot Line <br /> Adjustment shall not be recorded until the Williamson Act Contract has been deemed complete. <br /> Filing fees are required for this application. (Government Code Section 51257) <br /> d. SECOND UNIT DWELLING: A Second Unit Dwelling application shall be filed for the proposed <br /> second residence for Parcel Two before the recordation of the"Notice of Lot Line Adjustment'. Upon <br /> conveyance:AQf the new deeds the "Notice of Second Unit Dwelling" will be recorded for proposed <br /> Parcel Two..F,:iling fees are required for this application. <br /> e. LOT WIDTH: (The following requirements shall apply) <br /> (1) Parcel One shall be a minimum of 150 feet in width, measured at the front yard setback line. <br /> a (Development Title Section 9-610.4) <br /> (2) Parcel Two shall be a minimum of 330 feet in width, measured at the front yard setback line. <br /> (Develop.,ment Title Section 9-610.4) <br /> 2. DEPARTMENT OF PUBLIC WORKS: (Seethe attached memo dated September 9,2010) <br /> INFORMATION ONLY: SOUTH SAN JOAQUIN IRRIGATION DISTRICT: (See memo dated September <br /> 23, 2010) <br /> NOTES: APN: 105-14.0-08 is under Williamson Act Contract No. 73-C1-188. APN: 105-140-24 is not <br /> under a Williamson ct Contract. Parcel Two shall not increase in restricted acreage under Williamson <br /> Act Contract No. 73-',9-1-188 after rescinding and reentering. The proposed application is consistent with <br /> Government Code Section 51257. <br />
