CONDITIONS OF APPROVAL <br /> MS-94-2 <br /> Henry Shermantine <br /> Unless otherwise specified, all Conditions of Approval shall be complied with prior to the approval <br /> of the Parcel Map. <br /> This approval will expire three years from the date of approval unless (1) all Conditions of Approval <br /> have been compiled with and (2) a Parcel Map has been filed with and accepted by the Surveyor's <br /> Office. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance requirements. Ordinance requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. Parcels 1, 2, 3, and 4 shall contain a minimum of two acres net (Development Title <br /> Section 9-310.3). Parcel sizes shall be shown on the Parcel Map. <br /> b. The minimum width of Parcels 1, 2, 3, and 4 shall be 150 feet (Development Title Section <br /> 9-310.4). Parcel widths shall be shown on the Parcel Map. <br /> C. The existing shed on the property line between Parcels 3 and 4 shall be removed under <br /> permit and inspection of the Building Inspection Division prior to approval of the Parcel <br /> Map. <br /> 2. DEPARTMENT OF PUBLIC WORKS: <br /> a. A Parcel Map is required. (Development Title Section 9-915.2) (see memo dated April 14, <br /> 1994) <br /> b. The Traffic Impact Mitigation Fee will be required when the parcels are developed. The <br /> fee is due and payable at the time of building permit application. The fee currently is <br /> $1,651.00 per single-family dwelling unit in the Linden area. The fee shall be <br /> automatically adjusted July 1 of each year by the Engineering Construction Cost Index <br /> as published by the Engineering News Record. (Resolutions R-90-304, R-91-1025, and <br /> R-94-179) <br /> C. The frontage improvements for Milton Road shall be constructed in conformance with the <br /> standards for one-half of a 60-foot-wide right-of-way rural collector road. The frontage <br /> improvements along the west line of APN 093-120-01 shall be constructed in conformance <br /> with San Joaquin County standards for a rural residential road. The construction of the <br /> frontage improvements will be deferred upon execution by the owner of a Deferred <br /> Frontage and Roadway Improvement Agreement or a Secured Deferred Frontage and <br /> Roadway Improvement Agreement with a deposit equivalent to the estimated construction <br /> costs prior to approval of the Parcel Map. A $260.00 fee currently is required for <br /> processing, per Development Title Table 9-240.2, in addition to a copy of the Grant Deed, <br /> recording fee, legal descriptions of Parcels 1, 2, 3, and 4 and an estimate. The estimate <br /> and legal descriptions shall be prepared by a Registered Civil Engineer with a typical <br /> Conditions of Approval - 1 - MS-94-2 <br />
