I preferred to <br /> discuss this with you over the phone but was told by Carol Oz last Friday <br /> that I had to do so in writing. <br /> I am very aware of Proposition 65 and was surprised to hear that Stockton <br /> Plant #33 was put on a Proposition 65 list of contaminated sites. I had <br /> never heard of a "Prop 65 list" even though I work with production facilities <br /> _ in seven California counties. I also did not realize there was contamination <br /> at Plant #33, nor was I aware of any conditions which might be construed as <br /> contamination under California Health and Safety Code Section 25180.7(b) <br /> which requires a federal employee to report if an illegal discharge, or <br /> threatenled illegal discharge, of hazardous wastes is revealed, and who knows <br /> the discharge, or a threatened discharge, is likely to cause substantial <br /> injury to the public health or safety (not the case as far as we know) . <br /> My surprise stems from what I know happened when the tanks were removed in <br /> the fall of 1985. We wanted to take all the proper steps required in <br /> removing the tanks so Exceltech was contracted to handle this project.
