the Kahn property present a fire hazard. The 10 acres of Kahn <br /> property next to his does not even have a walnut orchard on it. <br /> The house on the Kahn property is not in livable condition. He <br /> felt that the conditions on this property would create environmen- <br /> tal problems for the area from the squirrels, voles and gophers <br /> that come from the tree stumps dumped on the property; and that the <br /> inability of Mr. Kahn to maintain the property will create a <br /> financial burden on San Joaquin County. <br /> Gordon Nelson (6066 Stanley Rd. ) , owner of property across the <br /> street from the subject property, said that in reality, Mr. Kahn is <br /> not a farmer or a walnut orchard grower. The weeds have been there <br /> since Mr. Kahn purchased the property. The farm is not competently <br /> tended. The house has been condemned. The AG-40 zoning was <br /> supposed to maintain agricultural-sized parcels and this size <br /> should not be broken down. He said he was afraid that approval of <br /> this project would allow a blight in the area. <br /> Gene Bartolomei (6511 S. Bartolomei Rd. ) concurred with the <br /> statements of the previous speakers concerning a fire hazard. He <br /> said any fire on the Kahn property would take in several rows of <br /> trees on the adjoining land and it would take 10 years for the <br /> trees to come back to production. The house on the Kahn property <br /> is not livable. He suggested another lot split design. He <br /> questioned why the proposed parcel being created had so much <br /> frontage, and if that was to further split off lots . He said that <br /> mice and rats come off of the subject property and create a <br /> problem. He said he did not think Mr. Kahn was an actual farmer in <br /> that only a minimum of tractor work had been done on the property <br /> over the past few months. <br /> Ralph Lida (6242 Bartolomei Rd. ) said his property is situated in <br /> the middle of the 10-acre parcel , and that when he bought his <br /> property he had understood the surrounding land was not going to be <br /> split. Rodents are a problem from the property. The shed on the <br /> property has 4 inches of walnuts on the floor and that creates an <br /> infestation of rodents. He said no one is presently living in the <br /> house on the property; that the house is unlivable. <br /> John Chiappe (5419 S. Stanley Rd. ) said he has been a farmer for <br /> many years and that the subject property is supposed to be farming <br /> land. Much of the area is under Williamson Act contract. The <br /> proposed split will cause problems for the area. He was concerned <br /> over a drainage problem on the property. When there are flash <br /> floods on Escalon-Bellota Road, water drains onto this property. <br /> REBUTTAL: Mr. Rishwain said that no one lives in the house at this <br /> time, but the intent is to remodel the house so Mr. Kahn can live <br /> in it. He said that many of the speakers in opposition have <br /> actually divided their properties. The subject property cannot be <br /> divided again because of the restrictions in the 2010 General Plan. <br /> This proposal meets the criteria for the land split. <br /> PUBLIC HEARING CLOSED <br /> -3- <br />
