1. MAJOR SUBDIVISION NO. PA-02-462 OF ROBERT&JUDY SCHEPPMAN AND CRV <br /> ENTERPRISES. INC.to subdivide four parcels totaling 32 acres into sixteen 2-acre parcels (Ashton <br /> Place No. 2). The project site is located on the northeast and southeast corner of Reid Avenue and <br /> Mondy Lane, and on the west side of Reid Avenue, 270 feet south of Mondy Land, southeast of Linden, <br /> in the rural community of Peters(Supervisorial District 4). <br /> Commissioner Solari said that he wished to pull this item from the consent calendar. <br /> Jennifer Jolley, Associate Planner, introduced the staff report into the record. She noted that the handout <br /> packet for the evening contained revised conditions from Public Works. <br /> PUBLIC HEARING OPENED: <br /> PROPONENTS: <br /> Monte Seibel, representing the owners, said they accept all the Conditions of Approval. <br /> Commissioner Solari asked if they have spoken to the school district about participating in the Mello Roos <br /> district. <br /> Monte Seibel said they have not. There is no Mello Roos district in that area. The project can be mitigated <br /> with the building permit. Other projects in this area have not entered into the Mello Roos. <br /> OPPONENTS: <br /> Ron Estes, Superintendent of the Linden School District, said he understands that school mitigation is <br /> outside the Commission's jurisdiction. He talked about the declining quality of life in Linden. Their school <br /> grounds are being used as parks. There is a concern about traffic impacts, which also affects agricultural <br /> activities in the area. They did not get a response from the applicant about them getting into the Mello Roos <br /> district. They collect the school fee only when a home is built, and the developer does not pay any of those <br /> fees. He said that$2.14 a square foot is not enough to mitigate for these impacts. <br /> REBUTTAL: <br /> Monte Seibel said that in regard to traffic, they are rebuilding about a one-half mile section of the road <br /> through their subdivision. Also, they are providing a connection road to allow further access. Regarding the <br /> impact to Linden, they are outside the Linden area and will not use parks in the town. They are paying park <br /> in-lieu fees for future park expansion. <br /> PUBLIC HEARING CLOSED: <br /> Commissioner Mond asked if they could continue this item to allow Mr. Seibel to work with the school district <br /> to come up with an agreement. <br /> Commissioner Solari asked Mike Huggins if he needed more time to look at the outdated septic systems. <br /> He asked who enforces the right-to-farm ordinance. What does this ordinance give to the farmers in San <br /> Joaquin County? <br /> Mike McGrew, County Counsel, said the right-to-farm ordinance and the school mitigation fee are beyond <br /> the scope of the Planning Commission. Also, they have to have the consent of the developer to continue <br /> this item because the Commission has to act upon subdivisions within a certain period of time. <br /> Mike Huggins, Environmental Health, said there are a large number of septic systems in this area. There is <br /> a lot of hardpan, and there will be a lot of septic failures because of that. <br /> PC MINUTES -2 - PC: 6-19-03 <br />
