20. Agricultural Operation Phasing: An Agricultural Buffer and Conversion Phasing Plan shall <br /> be submitted to the Community Development Department and approved by the Director. The <br /> plan shall incorporate the following: <br /> • Phasing of areas from agricultural to urban use–locations and time frames; <br /> • Irrigation water supply and service plan approved by BBID; <br /> • BBID encroachment permits; <br /> • Temporary buffering that includes a 100-foot setback(or as adjusted by condition 12) <br /> between the edge of development and ongoing agricultural operations as the project <br /> builds out; <br /> • Permanent setbacks; <br /> • Landscape buffers;and <br /> • Fencing, signage or other suitable measures to minimize noise, spray drift and limit <br /> the potential for trespass on agricultural lands and BBID facilities. <br /> In addition, the plan shall address the following: <br /> • Chemical applications <br /> • Dust management <br /> Timing: Condition shall be met prior to approval of the Final Map. [MP policies 3.2.4 g), h) <br /> and i)and Specific Plan III Implementation Measure 3.2.4.3. a and f] <br /> 21. Right To Farm Recordation And Notification: The deed of each parcel and of each <br /> condominium unit shall include the following recording notification, as specified by San <br /> Joaquin County Ordinance 4217 which added Section 6-9004 et. seq.to Chapter 1 of <br /> Division 9 of the San Joaquin County Ordinance Code regarding the Right to Farm Notice: <br /> "All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects,dust or fumes. San Joaquin County has determined that such <br /> inoonveniencies or discomforts shall not be considered to be a nuisance." [Implementation <br /> Measure 3.2.4.3.f] <br /> Timing: Prior to approval of Final Map(s). <br /> NOISE <br /> 22. Increase Traffic Noise: Before occupancy of the first residence at College Park, a noise <br /> barrier shall be constructed by the College Park developers between the five existing <br /> residences located on the north side of Grant Line Road between Central Parkway and the <br /> Alameda County line(Receptor 14 in Figure 4.13-2 of the College Park Final EIR)and the <br /> northern travel lane of Grant Line Road. The noise barriers may consist of a wall, berm, or <br /> combination thereof. The exact location, height, and character of the noise barrier shall be <br /> determined by a noise consultant approved by the County. The sound barrier shall reduce <br /> outdoor noise levels at the center of the front yards of the five existing residences to below 65 <br /> dBA LddCNEL. if Grant Line Road is widened at this location subsequent to construction of <br /> the sound barrier but before removal of the five residences under Specfc Plan II, the sound <br /> barrier shall be relocated, as required. If the five existing residences are removed under <br /> Specific Plan II before occupancy of the first residence under the College Park project, this <br /> mitigation measure shall not require implementation.This mitigation shall be funded through <br /> fair-share payments by the College Park developers. [MM 4.13-3] <br /> Timing: Design submitted with improvement plans for the first Final Map and compliance <br /> verified prior to the issuance of building permits. <br /> 23.
