Standardized Recommendations for Protection of the San Joaquin Kit Fox Before or <br /> During Ground Disturbance(USFWS 1999). <br /> • If no active dens are found during the surveys, a letter report documenting the survey <br /> methodology and findings shall be submitted to USFWS and DFG within 5 days after <br /> survey completion and before the start of ground disturbance or construction activity, and <br /> no further mitigation shall be necessary. <br /> • Any known or potential dens discovered within the survey area shall be monitored for 3 <br /> days to determine its current use. If no activity is observed during this period, the den <br /> shall be destroyed immediately to preclude subsequent use. If kit fox activity is observed, <br /> the den shall be monitored for at least 5 consecutive days from the time of the <br /> observation, to allow any kit fox occupying the den to move to another location. If it is not <br /> a natal or pupping den, use of the den can be discouraged during this period by partially <br /> plugging its entrance(s)with soil in such a manner that any animal can escape easily. <br /> The den may be destroyed when, in the judgment of a qualified biologist, it is no longer <br /> occupied by a kit fox or it is temporarily vacant. Methods for den destruction shall be in <br /> accordance with USFWS recommendations. <br /> • Occupied natal or pupping dens shall not be destroyed until the adults and pups have <br /> vacated the den and then only after consultation with USFWS. A 250-foot buffer zone <br /> shall be maintained around natal dens until the biologist determines that the den has <br /> been vacated. <br /> • Additional provisions of the Standardized Recommendations for Protection of the San <br /> Joaquin Kit Fox Before or During Ground Disturbance (USFWS 1999), including those for <br /> educating construction workers regarding kit fox, keeping heavy equipment operating at <br /> safe speeds, and checking construction pipes for kit fox occupation during construction, <br /> shall also be implemented. <br /> Jurisdictional Waters of the United States <br /> The College Park Developers shall implement Mitigation Measure 4.10-10. (MM 4.10-12) <br /> Timing: The applicant shall submit a biologist's report of pre-construction surveys to the San <br /> Joaquin County Community Development Department(CDD) prior to the issuance of grading <br /> permits for the project. <br /> 43. Endangered Species Act: In carrying out the operations of each Tentative Map, the <br /> applicant shall take no action that violates the California Endangered Species Act or the <br /> Federal Endangered Species Act. Compliance with said laws shall be the sole responsibility <br /> of the applicant and the applicant agrees to indemnify, defend and hold the County harmless <br /> from and against any claim or action by affected State agencies, or affected Federal agencies <br /> or other third party, as to the project's compliance with said laws. <br /> Timing: Improvement Plans prior to Final Maps and ongoing. <br /> 44. Wetland Mitigation: Wetlands mitigation shall provide for the creation of wetlands to replace <br /> those which would be lost, if any. Mitigation, if required by the Clean Water Act, shall occur <br /> within the Mountain House and Dry Creek corridors. <br /> Timing: The applicant shall submit an approved report of pre-construction surveys to the San <br /> Joaquin County Community Development Department(CDD) prior to the issuance of grading <br /> permits for the project. <br /> 45. Buffering: Where preserved wetlands provide valuable habitat to wildlife, protective fencing, <br /> screening or buffers shall be provided where necessary to minimize disruption of habitat <br /> areas. <br /> Timing: Fencing locations shall be shown on the Improvement Plans and placed in the <br /> approved locations prior to the onset of any grading or construction activities.
