3. Development: A Notice of Subdivision Restriction shall be placed on the Final Map and <br />recorded as a separate instrument that restricts the development of the subdivided lots and <br />the designated remainder, if any, until they are further subdivided. <br />4. Specific Fees: The applicant shall be subject to the following specific fees, unless said fees <br />have already been paid as part of a prior Major Subdivision application: <br />Agricultural Mitigation Fee. If a Countywide agricultural mitigation foo is established in the <br />future; aAn agricultural mitigation fee, based on each agricultural acre converted to an urban <br />use, shall be paid by the developer to the County as specified in Chapter 9-1080 of the San <br />Joaquin County Development Titlethe erdinanGe. Any lands that have a recorded Final Map <br />prior to the adoption of an agricultural mitigation fee shall not be subject to the fee. [MHMP <br />Implementation Measure 3.2.5 (a)] <br />Timing: Prior to approval of the Grading Permit(s) or Building Permit(s)Final Map(s). <br />Master Specific Plan Cost Reimbursement Fee. The developer shall pay the Master <br />Specific Plan Cost Reimbursement Fee. The fee will be placed in an interest bearing <br />account managed by the Community Development Department. Upon recordation of the <br />first Final Map, the fee shall be disbursed to the Mountain House Master Plan Master <br />Developer (Trimark Communities, LLC). The total fee is currently . (The fee shall be <br />automatically adjusted on July 1 of each year based on the change, if any, in the Consumer <br />Price Index for Urban Wage Earners and Clerical Workers—All Items, published by the <br />Bureau of Labor Statistics, U.S. Department of Labor (1967=100).) (Board Resolution R-01- <br />787) <br />Timing: Prior to approval of the Final Map(s). <br />Specific Plan III Cost Reimbursement Fee. The developer shall pay the Cost <br />Reimbursement Fee, if any, adopted for Specific Plan III. The fee will be placed in an <br />interest bearing account managed by the Community Development Department. Upon <br />recordation of the first Final Map, the fee shall be disbursed to the Master Developer of <br />Specific Plan III (Gerry N. Kamilos, LLC). The total fee is currently . (The fee shall be <br />automatically adjusted on July 1 of each year based on the change, if any, in the Consumer <br />Price Index for Urban Wage Earners and Clerical Workers—All Items, published by the <br />Bureau of Labor Statistics, U.S. Department of Labor (1967=100).) <br />Timing: Prior to approval of the Final Map(s) <br />5. Final Map Digital File: A digital file of the Final Map shall be submitted to the Community <br />Development Department. The digital file format shall be consistent with requirements of <br />the County Assessor and Community Development Department GIS division. <br />Timing: Prior to approval of Final Map(s). <br />Right To Farm Recordation And Notification: The deed of each parcel shall include the <br />following recording notification, as specified by San Joaquin County Ordinance 4217 which <br />added Section 6-9004 et. seq. to Chapter 1 of Division 9 of the San Joaquin County <br />Ordinance Code regarding the Right to Farm Notice: "All persons purchasing lots within the <br />boundaries of this approved map should be prepared to accept the inconveniences or <br />discomforts associated with agricultural operations or activities, such as noise, odors, insects, <br />dust or fumes. San Joaquin County has determined that such inconveniencies or discomforts <br />shall not be considered to be a nuisance."
